Curtis Johnson contends he shouldn't be on trial for assaulting a cop because he's an independent country.
The Cary resident faces four misdemeanor charges for allegedly scratching and pushing a police officer during a July traffic stop. In court documents, Johnson claims he's not a U.S. citizen but a separate country all his own.
He says the state's attorney doesn't have the jurisdiction to prosecute because he has diplomatic immunity.
A judge isn't buying the argument. Johnson is free on $1,000 bond and is due in court October seventh.
