Hello again all... Question

Hello all! We've been off line for a few days but finally got our computer fixed.
Long story short. Many of you know of our financial problems so I will not bore y'all with them again. We had our van reposessed last
week. Through Christ and lots of prayers, we were able to pay them today to get our van back. When we got the van back, it was scratched rather badly on the passenger side, there were beer cans on the floor, 2 burns on the drivers side and 'silly string' sprayed in the van. The wrecker driver/ repo-man acted like he didn't know what happened. He said it must have happened before he picked it up from us. The day the van was repo-ed, I washed and waxed it and cleaned it out. It was spotless with NO scratches, dents or dings and no trash inside. He said that he forgot to inspect it and that he needed to call his home office. In the mean time, we were late for picking our children up from school and our smallest girls birthday party (preparing for it that is). We told him that we had to have the van and that we would call him later about the damage. By the time we got home, the home office of the tow truck driver called us and said that they had found the pre-ickup report and that it stated that the van was badly scratched dented and dinged when he got it from us. These are all lies!! Unfortunatley, when we were picking up the car, I was told sign a paper and did so without reading it. My stupidity. He said it was just a formality for releasing it. The man at the home office laughed at us when we called and said "you signed the paper to accept the van as is- take us to court" and then hung op on us.
This is horrible. I don't know what to do. I have beaten up on myself for signing anything without reading it. We had a nice van and now it's trashed. I can't beleive my husband doesn't want to kill me but he's has been very understanding. Besides it being our daughters birthday today, it's our 15th wedding anniversary. I just feel I ruined it.
Does anyone know if we can do anything? I am ashamed for my children to get in the van but I don't want to touch anything just in case we are able to do something. Should I call a lawyer? Would it do any good?
I dont think I have ever been so mad and disappointed in another human in my life. I just want to cuss!!!!! (but I didn't).

Hi Diane!

I don't know all the legalities of the law, but I don't think it would hurt to talk to an attorney. If this has happened to you, I would be willing to think that it has happened to others. Some of it sounds supicious. If the guy forgot to inspect it, why was there a report on if all of a sudden? By the attitude of the person on the phone, they seem to think they are above the law. I think an attorney would be able to tell you whether or not you would have a cause of action against them. Some attorneys do not charge for the initial consultation to see if there is enough for a case.

This happened to me. I had a spotless Fiero that I parked on the street and forgot to move. It got towed and when I went to pick it up, it had some deep scratches on the hood and bumper, right where the sling from the tow truck would have rubbed it. The "pre-pick up" report said it had some scratches on it when they picked it up. I was so mad! My beautiful car was scratched and they wouldn't admit they did it.

I ended up making a police report for vandalism and claimed it on my insurance. I had to pay the deductible, but it was still better than paying for all the damage myself, and much easier than trying to take them to court.

Call your insurance agent and see what he/she says to do. Things like this are the reason you have an insurance agent, and even if you don't claim it on your insurance, the agent will help you decide how to proceed against the tow truck company.

Unfortunately our insurance had lapsed due to non payment. The insurance company cancelled our policy back in August 2002 and didnt even notify us. We just found out about this 3 days ago. I called the insurance company and they said they sent a 'card' stating that we were about to be cancelled but we never received it. Thats one of the reasons it was repossessed. I can't beleive the way things are going for us. In SOuth Carolina there is a law that you have to pay $200 per day if you go without insurance!! If we are charged this, we could never pay it.
Oh. My husband went for an interview last week and got the job. He just had to have a criminal background check done. When it came back to the employer, it had his arrests for simple possession and DUI from back in 1980!! Needless to say, he was passed over for the job.
Why is all this happening? That stuff happened to him before he gave his life to Christ.

If you had a loan on your car and your insurance got cancelled, the loan company probably took out insurance for you, and they'll bill you at the end of the loan for it. Virtually all car loans have this clause in the contract. Call the loan company and see if the enacted the forced account insurance for you. You might still be covered.

Barlowe, satan is a liar, and will bring everything he can find against you,and your family to turn you away from Jesus. But you have authority over him in the name of Jesus. The name above every other name. Jesus will meet you where you hurt, and will heal you, your finances,family,circumstances.
Your situation will not move God, your faith will. And when God moves things start to come together.
But if satan can distract you long enough, you will start to get overwhelmed by those circumstances,and then he's got you defeated. Right where he wants you.
I will be praying for you and your family, that God will do a mighty work for you.Keep lookin to Jesus,and just thank God, even if there looks like it's all lost, just thank him.God inhabits the praise of his people, and when you praise him, the bible says praise breaks the yokes,and praise will set you free.
