According to the Park Service the rehabilitation was going to happen anyway and was simply going to be an in kind replacement but they were contacted by at least one native tribe which lead to a consultation process which resulted in the current plan.

Pavement has deteriorated due to age, misuse, and inadequate initial construction. The original flowering trees failed in intense summer heat due the lack of an irrigation system. While replacement trees have done well, the absence of established vegetation gives an appearance of abandonment and hampers the public's ability to enjoy the site. Many of the original benches have been damaged or deteriorated and were subsequently removed. Insufficient lighting and a lack of cameras pose a security and safety risk to visitors and property.

I've never even heard of this park or this statute, and I imagine most outside of Philadelphia can say the same. Also, this is at this point only a proposed change and there is a comment period to respond against it. But honestly, since one of the things Penn is known for is his deep relationship with the local tribes, having a larger native representation makes sense to me.
