Meanwhile, the defamation case against Trump moves along.

New York federal judge Lewis A. Kaplan denied former president Donald Trump’s attempt to delay his deposition, set for October 19, in the defamation case brought against him by writer E. Jean Carroll.

Carroll has sued Trump for defaming her by claiming she lied when she said Trump raped her in the mid-1990s. Trump has appealed to substitute the United States for himself as the defendant in the case, since he was president when he said he had not committed the assault. A previous attempt on the part of Trump’s attorney general Bill Barr to substitute the U.S. for Trump failed, so, the judge pointed out, “this is a second bite at that apple.” Still, Trump wanted to pause the case while that appeal is pending.

“As this Court previously has observed,” Judge Kaplan wrote, “Mr. Trump has litigated this case since it began in 2019 with the effect and probably the purpose of delaying it.” He denied the attempt to stop Trump’s deposition, saying Trump “should not be permitted to run the clock out.”

Did you even read the earlier post? I'm not sure how this is a "dog and pony show" and the only lawyer I see bending this was Bill Barr. (Unless you want to count Trump's attempt to delay the current deposition.)

Short version:

Minor celebrity claims Trump raped her about 25 years earlier in a department store near his tower.

Trump calls her a liar. She sues for defamation.

AG Barr has the case defended by DOJ as if legally defending the president requires defending his offensive statements. Court eventually removes US government from case and restores Trump as defendant.

Judge orders deposition to proceed last week. Trump repeats the defamatory remarks.

Is he telling the truth? Is she? I don't know. That's what the suit and deposition are for.

It needs to be settled. If Trump is innocent. He would stop delaying legal stuff. Not that much will happen. But it's speaks volumes that he tries to delay things.

Trump reveals his hypocrisy frequently. He absolutely delays all his legal issues since learning the D's from Roy Cohn long ago. Deny, deflect, delay, distract etc. Here's a link to what Trump said today about the Supreme Court leak before Roe was overturned. I find it particularly funny how Trump has the audacity to whine about the investigators wasting time when that is his own go-to tactic when faced with legal problems. Trump said "Arrest the reporter, publisher, editor- you'll get your answer fast." Then he added "Stop playing games and wasting time!" I reckon Trump deems himself the only person worthy of wasting time in our justice system. He's simply a sad human being.

Trump's new attorney, Joe Tacopina, revived the issue in a letter to Kaplan last week, offering to turn over a sample of Trump's DNA to Carroll's lawyers if they first turned over more information from a report on the DNA that was found on the dress.

Kaplan rejected that proposal in his ruling Wednesday, noting that it came well after both sides had submitted all their evidence in the case, which is scheduled to go to trial in April.

"There is no justification for such a deal," Kaplan wrote, noting that Carroll had turned over the DNA report more than three years ago. If Trump's attorneys wanted information from the appendix that was not included in the report, they should have asked long before now.

Senior U.S. District Judge Lewis Kaplan said he couldn’t issue such an order in “good conscience,” especially in light of Trump’s continuing attacks on the jurist presiding over the former president’s criminal case.

On March 23, 2023, Kaplan said that he needed to protect jurors’ safety and privacy in light of Trump’s attacks on “courts, judges, various law enforcement officials and other public officials, and even individual jurors in other matters.”

Well there you go. The Judge ruled; the defense of knowingly airing people you know are lying about Dominion, because it was "newsworthy" has been scuttled.

FOX, just like they had to do with the Lou Dobbs case, will probably be settling in 5..4..3..2..
