The department wrote on the social platform X that Immigration and Customs Enforcement (ICE) officers were conducting “targeted surveillance on the last known address” of a migrant without legal status in Biddeford, Maine, at roughly 7 a.m. ET on Monday, when an individual departed the residence in a vehicle.

“The vehicle attempted to flee the scene and, fearing for public safety, an officer discharged his weapon,” DHS added.

...The man who was shot was a 26-year-old Colombian citizen who was authorized to work in the U.S. and had a Social Security number, according to the Maine Immigrants’ Rights Coalition and Presente! Maine.

“A 26-year-old man came to Maine to live and work, and now his family is mourning his death following an incident involving ICE. This is devastating, enraging, and unacceptable. His loved ones deserve answers, and the public deserves a full and transparent account of what happened,” the organizations wrote in a joint statement.

It comes less than a week after an undocumented migrant was fatally shot in Houston by an immigration agent.

The name of the deceased man is not being released until he is formally identified and his family are notified, the statement added. Although investigators have not named him, local lawmakers and neighbours have identified him as Joan Sebastian Guerrero.

It is interesting in this case that they're not asserting the driver was trying to run the agents over, but some fear for general public safety.

We can't assume they're lying, but they have burned up their trust, particularly when it comes to the people they have killed.

That's the problem with Trump's DHS. If one is legally going through the legalization process, they are still fair game for that 3,000 per day head count. Heck, even US citizens who they choose not to believe.

AUGUSTA, Maine (AP) — The Immigration and Customs Enforcement officer who shot a Colombian man in Maine this week is an Army veteran who has struggled with serious mental health issues since early childhood and never should have been given a badge and gun to patrol American streets, several of his close relatives told The Associated Press.

David Brouillette has a history of terrifying and violent behavior, according to those relatives. They accuse him of attacking women in his life over the years, and one shared a voicemail with the AP from last winter in which he told her that he thought someone should slit her throat.

Brouillette's troubling past further challenges how thoroughly the Department of Homeland Security has vetted recruits as it went on a hiring spree to help carry out President Donald Trump's immigration crackdown.

Ashley Brouillette told NPR her ex-husband, David Brouillette, was the officer who fatally shot Joan Durán Guerrero four times during an attempted traffic stop in Biddeford, Maine, on Monday. She said she found out he was the officer responsible when he called her on Wednesday, asking her to vouch for his character.

"He asked me to basically talk good in his character, not to talk bad about him. And if I couldn't not talk bad about him, then just not to talk at all to anybody," she told NPR. "And I told him that I was not going to lie for him. He asked me not to talk about the abuse in our marriage. And I told him again I was not going to lie for him."

...When their marriage had collapsed and they were in the middle of a contentious divorce in 2009, she says she reached out to Brouillette's platoon leader in the Maine Army National Guard. She offered to fax over paperwork showing that he had been diagnosed as having bipolar disorder and borderline schizophrenia but they dismissed it as ravings of a "petty ex-wife," she says.

...Ashley Brouillette is unsure if there was a background check. If there had been, they might have seen a trail of violence. Like the time, in 2022, when Ashley says child protective services and the police were both called to his home after he threw his then-13 year-old daughter through a glass coffee table.

In a 2021 court filing, David Brouillette was stripped of his firearms temporarily. In the filing, his second ex-wife, Lucinda Brouillette, accused him of becoming more aggressive with their then 13-year-old daughter.

Fear for public safety, without evidence, is not a legal reason for deadly force. This does not appear, at this time, to be a lawful use of force. Baring any new evidence, this agent could and probably should face criminal charges.

The FBI will no longer investigate any purported misdeeds (kidnapping, murder, etc) of ICE agents. Local police are on their own.

Federal agents around the country were told in recent days that the F.B.I. would no longer investigate confrontations with immigration agents — cases that sometimes yield evidence that could be used to prosecute Department of Homeland Security agents implicated in violent encounters, according to people briefed on the decision.

...A joint statement by the Justice Department and the Department of Homeland Security, however, denied that any such change was underway.

“The relationship between D.H.S. and D.O.J. in investigating assault on federal officer cases has not changed, and F.B.I. will continue to investigate in accordance with agency policy,” the statement said. “This administration has been clear, anyone who assaults law enforcement will be prosecuted to the fullest extent of the law.”

Under the change, responsibility for investigating cases involving federal immigration officers would likely fall to Homeland Security Investigations, an arm of ICE, effectively leaving the agency to investigate itself, according to guidance circulated among F.B.I. and ICE agents.

...Homeland Security Investigations does not have jurisdiction to investigate civil rights violations, so putting the change into practice would make it far less likely that shootings of unarmed people by ICE agents would be investigated to determine if the agents broke federal law.

We'll see how this shakes out. The FBI and the DOJ have been hollowed out, especially with regards to civil rights.
