  • CF has always been a site that welcomes people from different backgrounds and beliefs to participate in discussion and even debate. That is the nature of its ministry. In view of recent events emotions are running very high. We need to remind people of some basic principles in debating on this site. We need to be civil when we express differences in opinion. No personal attacks. Avoid you, your statements. Don't characterize an entire political party with comparisons to Fascism or Communism or other extreme movements that committed atrocities. CF is not the place for broad brush or blanket statements about groups and political parties. Put the broad brushes and blankets away when you come to CF, better yet, put them in the incinerator. Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

Government asking for more time to invent its case. Looking for a 'complex case' designation.

The Government estimates that discovery will include approximately 2,000 pages of reports and various other documents, plus multiple videos of the incident, BWC videos of St. Paul PD interviews of some church members/victims, photographs, and data from cellphones and social media.
Boy, that's a lot of evidence.

Since the city attorney saw all the evidence, they were able to make a far more informed decision than any internet "lawyer" sitting behind a keyboard can make.

The Dailycaller article didn’t say, nor does her LinkedIn page…is this important?
Well, I was able to find out with a few seconds of research. She's a democrat.

Those rioters at that church are still facing federal charges.
Hopefully a federal judge will be more objective in their findings than the St. Paul city attorney.

What are the federal charges?
What federal charges could be brought against Don Lemon?

Journalist Don Lemon faces federal charges of conspiring to violate civil rights (specifically the right of religious freedom) and violating the FACE Act (Freedom of Access to Clinic Entrances Act). These charges stem from his coverage of an anti-ICE protest at Cities Church in St. Paul, Minnesota, where demonstrators disrupted a church service. [1, 2, 3, 4]
The Department of Justice indicted Lemon on the following counts:
  • Conspiracy Against Rights (18 U.S.C. § 241): A federal charge that makes it illegal to conspire to injure, oppress, threaten, or intimidate individuals in the free exercise of their constitutional rights. [1, 2]
  • Violating the FACE Act (18 U.S.C. § 248): While originally created to protect access to reproductive health clinics, the law also prohibits the use of force, threats, or physical obstruction to intentionally interfere with anyone exercising their First Amendment right to religious freedom at a place of worship. [1, 2]
Federal authorities arrested Lemon following a grand jury indictment. Lemon and his legal team maintain that he was simply present at the scene acting in his capacity as an independent journalist, and they have vowed to fight the charges in court. [1, 2, 3]

At this point, only Don Lemon is under indictment as the other defendants have had their cases dropped.
Lemon is seeking the transcripts from the Grand Jury, due some hijinks in the first linked article.

Is he playing the martyr card?
Not that I've seen. Instead, he is playing on the fact that the DoJ has been found in several instances to have made inappropriate, if not false, claims to grand juries in order to get an indictment and he/his lawyers want to ensure the DoJ did not do the same thing to get the indictment against Lemon. Based on the examples the lawyers listed in the motion, it does appear to be a smart legal strategy.

You know that self-employment is a thing, right?

It is... but when self-employment is in the realm of a vocation that gets special rules and exemptions/protections, it becomes murky waters.

Not saying this next part would apply to Don Lemon or not (I'm honestly not sure of how big of an outlet he has or doesn't have now that he's gone solo)

There's an interesting thing that I've noticed happening where people want to claim the title of "independent journalist" to try to exercise press protections and exemptions for certain things on grounds that "I'm just reporting on what's happening"

I've thought about this before, but I don't know how one would draw the line.

On the two polar ends of that spectrum.

Full fledged, institutionally recognized journalist, working for a national news outlet, and reporting to millions of people
vs.
Random guy with 18 twitter followers out there recording with this cell phone claiming "you can't tell me to leave because I'm a journalist" and "you can't punish me for what looks a lot like participation, because I'm merely reporting on it"

Obviously "the line" exists somewhere between those two.

We have to give room to more than just the CNN/NBC/Politicos of the world, but at the same time, we can't swing those doors open so wide that we have every rando out there whipping out a cell phone and saying "I'm the press, so I'm allow to enter this private establishment to record and ask questions and upload it to my Facebook page"

Is he playing the martyr card?
He’s asking the court for grand jury transcripts, in part to ascertain whether the unusual grand jury procedures that negated fellow defendants’ cases also might apply to his, lone, case.

Sources are in there, all but one are months old. The new one is just reporting that the rest of the defendants won’t be facing State charges.

A rigged court? I've heard that doesn't happen.
