A federal judge ruled Thursday that university association members may seek relief from the court if their immigration status is changed as retribution for challenging an alleged Trump administration policy to single out campus activists critical of Israel’s war in Gaza for immigration enforcement.

U.S. District Judge William Young’s order follows a trial last year where he found top Cabinet officials conspired to target noncitizens for deportation on account of their support for Palestinians and criticism of Israel.

At a hearing last week, Young said Homeland Security Secretary Kristi Noem and Secretary of State Marco Rubio operated an “unconstitutional conspiracy” to deport certain people so the university association members would be hesitant to speak out.

"When it comes to immigration detention hearings in Minnesota federal courts ... of the 61 that came before judges last week, the Department of Justice and immigration enforcement lost all but one," said Geist. "So, Lisa, what are we talking about specifically here? What kind of cases are these?"

"As you noted, there were 61 of them and 60 of them the immigrants won," Rubin said. "And what they won was either their release in 40 of these cases, or they got an order from a judge saying, you have to have a bond hearing for these people. If you don't have a bond hearing, you must release them in X number of days in some of the cases. But 40 of the cases, 40 of these 61 cases, you have federal district judges and Minnesota saying this person must be released. Why? Because either there was no administrative or judicial warrant when you arrested them, you didn't give them the hearing to which they were entitled by due process."

Maine’s Chief U.S. District Court judge orders ICE to release asylum seeker who was arrested without warrant

Maine’s Chief U.S. District Court judge told immigration officials on Friday they had two hours to release an asylum seeker who was arrested last week without an administrative warrant.

Makuiza has no criminal history, according to her lawyer, and has been waiting since an interview last summer for an answer on her asylum application.

Thursday’s big news, delivered early in the morning by Maine’s senior U.S. Sen. Susan Collins, was that U.S. Immigration and Customs Enforcement would be suspending its targeted operation, dubbed “Catch of the Day.”

Judge Lance Walker says in his order that Makuiza’s status as an asylum seeker had no bearing on his order – instead, he was more concerned with the lack of an administrative warrant.

“I have no difficulty appreciating that the Department of Homeland Security or Immigration and Customs Enforcement should be permitted to effectuate the orderly application of federal immigration law prescribed by Congress,” Walker, who was nominated by Trump in 2018, wrote in the order. “However, I question the notion that the activities that have brought Petitioner and others to court via habeas petitions have generally born the hallmark of orderliness or meticulous observation of statutory details.”

Trump issued the executive order at the center of the birthright citizenship case on Jan. 20, 2025. The order, which has never gone into effect, would bar automatic citizenship for babies born in the United States if their parents are in this country either illegally or temporarily.

The April 1 argument will be the first time that the justices will officially consider the legality of Trump’s order. After several federal courts around the country blocked the government last year from enforcing the order, the Trump administration asked the court to weigh in on the power of federal district courts to issue orders – often known as “universal” or “nationwide” injunctions – that prohibit the government from implementing a law or policy anywhere in the country. The Supreme Court ruled in late June that federal judges generally cannot issue such orders.

Judge blocks Trump administration push to fine UCLA $1.2 billion for alleged antisemitism

“Agency officials, as well as the president and vice president, have repeatedly and publicly announced a playbook of initiating civil rights investigations of preeminent universities to justify cutting off federal funding, with the goal of bringing universities to their knees and forcing them to change their ideological tune. Defendants submit nothing to refute this.”

Trump administration drops appeal of court order blocking $1.2-billion UCLA settlement

In a Wednesday filing with the 9th Circuit Court of Appeals, Department of Justice lawyers asked judges to dismiss an appeal it filed last month seeking to reverse a lower court decision. The November ruling — a major victory for UC workers who sued — had stalled the fine and a 27-page settlement document outlining administration demands to push the university ideologically rightward.

The update also says that the government cannot “coerce the UC to agree to any of the terms” of the August settlement offer by violating the 1st Amendment or 10th Amendment when it comes to giving, withholding or ending federal grants.
