Immigration judge fired by Trump administration files lawsuit claiming discrimination

Tania Nemer is one of scores of immigration judges that have been dismissed.

Nemer was "abruptly fired" in the middle of her probationary period despite receiving "the highest possible performance," the lawsuit alleges.

The former Cleveland judge is among the more than 100 immigration judges who have been fired, resigned through the Department of Government Efficiency's "Fork in the Road" offer, or transferred out of immigration adjudication, according to the union representing immigration judges.

The lawyers called the DOJ's position that it can fire federal employees without a reason -- despite civil rights statutes -- a "breathtaking assault on a landmark federal statute."
Among the hundreds of reforms needed, it is clear that the system of immigration judges under the control of the DOJ is not good. Put them under the management of the district courts like the magistrate judges.

Trump administration fires 8 immigration judges in New York City

It comes after a judge fired by the administration sued claiming discrimination.

The judges who were dismissed worked at 26 Federal Plaza.

The latest firings also come as the Department of Homeland Security is actively hiring "deportation judges."

Judge to address how he'll proceed with contempt inquiry into AEA deportations

U.S. District Judge James Boasberg, in a hearing Wednesday, is set to address how he will proceed with the early stages of contempt proceedings into whether Trump administration officials violated a court order by deporting hundreds of men to El Salvador under the Alien Enemies Act in March.

Judge orders top DOJ attorney to testify about Alien Enemies Act deportations

U.S. District Judge James Boasberg ordered Drew Ensign -- Deputy Assistant Attorney General for the Office of Immigration Litigation of the Civil Division -- to testify during a hearing on Dec. 16.

He also ordered testimony on Dec. 15 from Erez Reuveni, a former DOJ attorney who alleged the Trump administration evaded court orders.

He wrote that DHS Secretary Kristi Noem's brief sworn declaration recently submitted in the case did "not provide enough information for the Court to determine whether her decision was a willful violation of the Court's Order."

Judge orders administration to submit plans for return of migrants deported to El Salvador prison under AEA​

U.S. District Judge James Boasberg on Monday ordered the Trump administration to submit plans to return or otherwise provide hearings for over 200 migrants who were deported to El Salvador's CECOT mega-prison in March.

Boasberg has certified a class representing all migrants sent to the prison and says the government must submit its plans to allow them to contest their designation under the Alien Enemies Act by Jan. 5.

DOJ’s misconduct complaint dismissed against judge in Alien Enemies Act case

The Justice Department accused Judge James Boasberg of making prejudicial comments about Trump, but a judge for the Sixth Circuit said such comments are normal.

In his newly released dismissal of the misconduct complaint, Jeffrey Sutton, chief judge of the U.S. Court of Appeals for the 6th Circuit, said that the DOJ failed to provide sufficient evidence of Boasberg’s supposedly prejudicial statements and noted that such conversations between judges are normal during this kind of event. Sutton’s decision was issued Dec. 19.

“A key point of the Judicial Conference and the related meetings is to facilitate candid conversations about judicial administration among leaders of the federal judiciary about matters of common concern,” Sutton wrote. “In these settings, a judge’s expression of anxiety about executive-branch compliance with judicial orders, whether rightly feared or not, is not so far afield from customary topics at these meetings.”
