Demoting Kelly or divesting him from his retirement pay, is not "All within the rights and responsibilities of the Secretary of War."

It's a Judicial Branch matter, not an Executive Branch matter.

Edit: Unless Hegseth decides simply to break the law and orders his Pentagon staff to do so. That also falls under the "don't obey illegal orders" situation. We could conceivably see those cases springing more from Pentagon accounting offices than from the battlefield.

He stated a process, and you don't know that process. I just told you the process.

Hegseth only has authority over administrative changes. Unless Kelly's retirement was an administrative error from the beginning, it can't be changed administratively as a punitive measure. Nowhere in Executive Branch processes is that permitted.

The only way to affect Kelly's retirement status (either pay or rank) punitively is by court-martial. A federal judge (which includes military courts) must order it.

The official department name is still Department of Defense until Congress amends the 1947 legislation that created it.

I dont' think you quite understand how "reality" works; you certainly don't understand "truth".

I mean, he wasn't even sworn is as the secretary of war...he was sworn in as the secretary of defence and then they played pretend and changed the name in imaginary land to impress weak minded, authoritarians who love seeing people subjugated.

When your politicians make pronouncements as they are so very wont to do, the mere blathering, does not make it factual or true. He wants to be known as the secretary of war cause that means he's a tough guy and he wants to be seen as a tough guy.

Why should I respect that?

I think the most interesting thing about all these Republican name changing things is, honestly, it feels a lot like the trans language debate and I am 100% sure that they don' see the irony of that.
