Demoting Kelly or divesting him from his retirement pay, is not "All within the rights and responsibilities of the Secretary of War."
It's a Judicial Branch matter, not an Executive Branch matter.
Edit: Unless Hegseth decides simply to break the law and orders his Pentagon staff to do so. That also falls under the "don't obey illegal orders" situation. We could conceivably see those cases springing more from Pentagon accounting offices than from the battlefield.
