In view of recent events emotions are running very high. We need to remind people of some basic principles in debating on this site. We need to be civil when we express differences in opinion. No personal attacks. Avoid you, your statements. Don't characterize an entire political party with comparisons to Fascism or Communism or other extreme movements that committed atrocities. CF is not the place for broad brush or blanket statements about groups and political parties. Put the broad brushes and blankets away when you come to CF, better yet, put them in the incinerator. Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

Man accused in killing of Brian Thompson will not face state charges of first- and second-degree murder but will still face other charges

Luigi Mangione scored a major legal victory on Tuesday with a judge dismissing the two top state charges against him: first-degree murder and second-degree murder, both of which prosecutors had argued were terrorism crimes.

Mangione still faces an additional second-degree murder charge, as well as a federal murder charge, in the killing of United HealthCare executive Brian Thompson last December.

“Counts 1 and 2, charging defendant with Murder in the First Degree (in furtherance of an act of terrorism) and Murder in the Second Degree as a Crime of Terrorism, are dismissed as legally insufficient,” Carro wrote. “The People presented legally sufficient evidence of all other counts, including Murder in the Second Degree (intentional).”

Mangione also faces federal charges for allegedly gunning down Thompson outside a hotel, and weapons possession counts.

I wouldn't read too much into that. NY apparently defines its flavors of murder somewhat differently than other states. For many of us, our concept of "murder 1" just means that it was deliberate and premeditated. In NY, it has to be deliberate and premeditated AS WELL as meet one of a number of other criteria including: the target being a public servant or official; the murder was part of a larger conspiracy; the murder was intended to be an act of terrorism; etc.


It sounds like the state failed to show that this was anything other than "normal" premeditated murder which, in NY, is classified as murder 2.

I wouldn't read too much into that. NY apparently defines its flavors of murder somewhat differently than other states. For many of us, our concept of "murder 1" just means that it was deliberate and premeditated. In NY, it has to be deliberate and premeditated AS WELL as meet one of a number of other criteria including: the target being a public servant or official; the murder was part of a larger conspiracy; the murder was intended to be an act of terrorism; etc.

Yes, it seems as though each state has its own rankings of murder and such.
