Justice Brett Kavanaugh, who sided with the conservative majority in Monday's decision, took issue with whether the tactics violate the Constitution. Kavanaugh, nominated by President Trump in 2018, said Los Angeles' large population of undocumented immigrants "tend to gather in certain locations to seek daily work," frequently work in construction-related jobs and may not speak English.

"Whether an officer has reasonable suspicion depends on the totality of the circumstances," Kavanaugh wrote. "Here, those circumstances include: that there is an extremely high number and percentage of illegal immigrants in the Los Angeles area; that those individuals tend to gather in certain locations to seek daily work; that those individuals often work in certain kinds of jobs, such as day labor, landscaping, agriculture, and construction, that do not require paperwork and are therefore especially attractive to illegal immigrants; and that many of those illegally in the Los Angeles area come from Mexico or Central America and do not speak much English.

"To be clear, apparent ethnicity alone cannot furnish reasonable suspicion; under this Court’s case law regarding immigration stops, however, it can be a 'relevant factor' when considered along with other salient factors."

Any military person who has ever done a CBT on human trafficking can tell when the woman giving them a back massage is being used as a sex slave. So please explain in what scenario, other than some random tourist trying to cosplay as an illegal immigrant, would someone be hanging out at a Home Depot parking lot begging to roof your home, cash only, and cannot speak a single word in English? Please! I beg you! Explain!

A federal district court said that ICE could not stop people solely based on race, language, location, or job. The Supreme Court, in the opinion written by Kavenaugh, overturned that ruling. So yes, Kavenaugh effectively said, "ICE can stop people for looking like immigrants, doing the jobs that immigrants do, or speaking Spanish."

Now, you may not have a problem with that. You may think that it's reasonable. But it's also what he said.

All I am saying is that if you are sitting in a Home Depot parking lot looking for trabajar because you cannot speak English and you are looking to get paid in cash, there is a 99% chance you are in the country illegally. All you have demonstrated is that an illegal Canadian can go much farther because they can actually speak English, nothing more.
So the goal is to profile and get rid of just the brown people. We are OK with the white, English speaking Canadians. The brown Spanish people, though… Round ‘em up.

You do not have to answer any questions of ICE or any law enforcement officers. However, if it is a "Terry stop" and they ask you your name and you don't provide it, citizen or not, they can detain you.
They can only stop you if they have reasonable articulable suspicion of a crime, and it is not a crime to not give your name in any state in the union.

Okay. And the vast majority of people with common sense agrees too. I work at a hardware store. Do you know how many women have come into my store to exchange an item and could not speak a lick of English? Where I had to call upon a Spanish speaking employee from the jewelry department to translate the fact that I need to see some form of identification before I can make such a return? Only for these women to walk off in frustration because they could not scam the company? Countless!

Is not probable cause for arrest. Is probable cause to suspect. Is probable cause to detain for questioning.
And after questioning and investigation, 99% of the time, there is enough probable cause to arrest.
