You can't claim cruel and unusual iuntil it has been applied. But just as Trump's fines were over the top on his charges, (now overturned) the near 1000 a day fines are also over the top. I like mercy in the court system and even in immigration offenses. I am not familiar enough with the U.S. capital offenses to know if they received cruel punishment. If I remember right, at least one court lowered the penalty for some involved. Trump too saw to their pardons, some that were violent maybe even got off too easy?
If there are major fines to immigrants I suppose that some will appeal and see if it is cruel or not. At 1000 a day even if you had a million it would be wiped out in three years. So it is impractical because most can't pay the fines, and taking all income and wealth from immigrants does seem cruel. It is not necessarily unjust to remove them, but to take homes etc that they have built up is.
It is not just Joe Biden that allowed illegals in the USA. It was conservative and liberals alike that favor globalization. I would argue that the USA lack of enforcement is really an off the books policy by at least several administrations. This attitude from those in charge, GOP and Dem. seems to want a sort of common market like the EU has with free labor mobility between nations but they can't do it politically so they were allowing it under the table. For the GOP, many wanted cheap foreign labor, for the dems, they wanted new voters, the worse of the groups want instability so that the US will be divided and more apt to be primed for world government. So they took the political path that was open and opted to not protect the USA border. This is in part why I am sympathetic to working illegals. In a sense I can see them as victims of a much bigger game.
Those that self deport from a 6 month overstay will have to wait 3 years to apply for a visa. Those that have been here over a year will have to wait ten years. Of course you have to have 125% of the poverty line to be eligible, plus a reason such, as a family member.
I think it is good Christian policy to support illegals that have U.S. citizen spouses. To give them mercy in staying in the USA. Breaking up families or forcing US citizens to move to poor nations with their kids is not my idea of the love of God. In some cases there are illegal kids that were brought here with their parents and have no clue about their home country. I think that Jesus would let them stay. The earth is the Lord's and all it contains. Man steals, conquers and divides it. I am not saying take everyone, but a Reagan like amnesty will still likely occur once Trump is gone. I personally don't get it. The USA has plenty of room, and plenty of jobs right now. Deport the criminals and let the families stay. Why is that not a loving policy? What is the hatred about foreigners or if not hatred, the application of the law much like a Pharisee, that suggests every little immigration point must be followed. Trump makes exceptions to laws all the time. Currently the federal government allows pot to be sold in states in direct violation of Federal law and no one does a thing, except maybe slowly try to change the law. I am not saying you or anyone in particular is wrong but think about it a bit more. What are your motivations to deport working illegals especially those with families?
I myself recently overstayed my visa in a foreign country, because a storm shut the immigration center down. It was too busy for me to wait 3 hours as there were too many people once it finally did reopen. So I came a few days later and was fined an extra 20 dollars and got all my papers in order. I am glad the authorities are decent like that in most nations. It is too bad that right now the USA is not one of those countries. So you know I like Trump for some things, and yes he should close the borders and create some respect for US immigration policy. But the ICE demeanor that he created is not one of mutual cooperation or respect. It is designed to project power and fear and while that is fine for those who are violent, it is detrimental to loving people who just want to have a chance to have work for themselves and stay with their families.
Anyway, I thought it might be good to air out my thoughts on this. I doubt it changes anyone mind but at least understand where some like myself are coming from. To an extent, it is interesting that my ideas for immigration in the USA is similar to those of Mormons. They are not gung ho on restrictions, in part because quite a few of their new converts are US illegals, also that they were pushed from lands for being different. They suggest it is the love of God to feed and attend to even illegals needs.
