NYT: Arizona Charges Giuliani and Other Trump Allies in Election Interference Case

Rudolph W. Giuliani, Mark Meadows, and a number of others who advised Donald J. Trump during the 2020 election were indicted in Arizona on Wednesday, along with all of the fake electors who acted on Mr. Trump’s behalf there to try to keep him in power despite his loss in the state.

Boris Epshteyn, one of Mr. Trump’s top legal strategists, was also among those indicted, a complication for Mr. Trump’s defense in the criminal trial that began this week in Manhattan over hush money payments made to a porn star, Stormy Daniels.

The indictment includes conspiracy, fraud and forgery charges, related to alleged attempts by the defendants to change the 2020 election results. Arizona is the fourth swing state to bring an elections case involving the activities of the Trump campaign in 2020, but only the second after Georgia to go beyond the fake electors whom the campaign deployed in swing states lost by Mr. Trump.

The former president, who is seeking another term, was also named an unindicted co-conspirator in the Arizona case. Mr. Giuliani is Mr. Trump’s former personal lawyer; Mr. Meadows was the White House chief of staff at the time of the 2020 election.

Also indicted were Mike Roman, a Trump campaign operative in 2020, John Eastman, an architect of the fake electors plan, and two other lawyers who advised Mr. Trump and his 2020 campaign: Jenna Ellis and Christina Bobb.

The indictment lays out a series of alleged efforts by the defendants to overturn Arizona’s election results; they are accused of pressuring “officials responsible for certifying election results to encourage them to change the election results,” including the governor, the legislature and the Maricopa Board of Supervisors.

In all, 35 people who acted as fake electors in Georgia, Michigan, Nevada and now Arizona face criminal charges for signing certificates in 2020 falsely stating that Mr. Trump had won their state’s electoral votes.

A team of prosecutors and investigators for Arizona Attorney General Kris Mayes (D) has made multiple attempts to serve Giuliani a summons — essentially a formal notice that he has been criminally charged here and must appear before a judge May 21, said Richie Taylor, a spokesperson for the office.

The day after a grand jury handed down the indictment, Taylor said two agents for the state attorney general traveled to New York City, where they hoped to hand-deliver the summons to Giuliani. The agents determined that Giuliani was in his New York apartment because he had recently video streamed from his residence, he said. The agents matched the setting of the video stream with pictures of the interior of his residence from an old real estate listing that is still online.

A person at the building’s front desk told the agents that they were not allowed to receive service of documents. The person did not dispute that Giuliani lived there, Taylor said.

“We were not granted access,” Taylor said.

Giuliani on Friday said on X that he was having an "early-birthday celebration in Florida."

John Eastman, an architect of former President Donald Trump's plan to stop the certification of the 2020 election, entered a plea of not guilty in a Maricopa County court on Friday morning.

The former Trump attorney is the first of 18 people indicted last month in Arizona to appear in court and answer to charges stemming from the election nearly four years ago.

Eastman and others are facing nine felony counts in Arizona, including conspiracy, forgery and fraud. If convicted, the crimes could carry prison time, though state law allows for less severe penalties, including probation, depending on a defendant's circumstances, like past criminal history.

Rudolph W. Giuliani and 10 other allies of Donald J. Trump were arraigned and entered not-guilty pleas on Tuesday in an Arizona criminal case that charges them with trying to keep Mr. Trump in power after he lost the 2020 presidential election.

Mr. Giuliani, who appeared virtually at his arraignment, was ordered by the court to appear in person within 30 days and pay a $10,000 appearance bond. Those conditions, which were not imposed on other defendants, came after prosecutors said Mr. Giuliani had taken numerous steps to evade their attempts to serve him with notice of his indictment.

Arizona attorney general: First 'fake elector' agreed to flip in MAGA election plot case

"We are going to have a very significant announcement to make early next week," Mayes told 12 News' "Sunday Square Off." When she was asked if this means one of the electors plans to flip, she said, "I think that's accurate," and added, "We're making progress in the case, and we feel good about the case."

Mayes did not specify which [fake] elector is expected to strike a deal.

PHOENIX — Arizona Attorney General Kris Mayes (D) reached a cooperation agreement Monday with Jenna Ellis, who was a legal adviser to Donald Trump’s 2020 campaign and was one of 18 defendants indicted in April on felony charges related to alleged efforts to try to subvert President Biden’s victory in the state four years ago, according to prosecutors.

The attorney general has agreed to drop nine felony charges against Ellis in exchange for her full cooperation with the investigation into the GOP plan to try to deliver Arizona’s 11 electoral votes to Trump instead of the rightful winner, Biden.

Loraine Pellegrino, a prominent Republican in the state has become the first person to be convicted. Pellegrino, a former president of the Ahwatukee Republican Women, pleaded guilty to a misdemeanor charge of filing a false document in an effort to help Donald Trump overturn the election results.

Pellegrino was initially facing nine felony charges.

She was sentenced to unsupervised probation, according to a statement from the Arizona Attorney General’s Office. It’s unclear if Pellegrino is now helping prosecutors as the court has not yet made her plea records public.

At a hearing Monday, which is ongoing, several defendants, including conservative attorney John Eastman and multiple Arizona Republicans who served as fake electors, are present in the courtroom. Former White House chief of staff Mark Meadows, former Trump lawyer Rudy Giuliani and Christina Bobb, who serves as the top lawyer for the RNC on election integrity, have joined the hearing virtually.

This is the first high-stakes hearing since a grand jury handed up criminal charges against the fake electors from Arizona.

The pivotal hearing comes just days after Trump, who has not been charged in the Arizona case but is described in court documents as “unindicted co-conspirator 1,” held a rally in the key swing state as part of his 2024 presidential campaign.

In the meantime, prosecutors in Arizona are forging ahead with their case against the 18 others who have been charged and are eying a potential trial date in early 2025.

Arizona prosecutors secured their first victory earlier this month when former Trump 2020 campaign lawyer Jenna Ellis agreed to cooperate in exchange for the charges against her being dropped.

One of the Arizona fake electors facing state level criminal charges also reached a plea deal with prosecutors earlier this month.
