An obscure provision of Ohio law could keep Biden off the ballot in November

President Joe Biden might not appear on the November 2024 presidential ballot in Ohio. Ohio law requires that presidential candidates be certified – that is, the state must be notified that presidential candidates have been officially nominated – 90 days before the general election in order to get on the ballot. That is the earliest deadline of any state.

But the Democratic National Convention that will formally nominate Biden won’t open until nearly two weeks after Ohio’s Aug. 7 deadline. The Republican National Convention will wrap up nearly three weeks before the deadline, so Donald Trump won’t have a problem getting on the ballot.

The 90-day deadline has often caused trouble since its adoption in 2010. Only in 2016 did both parties’ conventions take place before the Ohio cutoff date. Both conventions took place after the deadline in 2012 and 2020, and legislators extended the deadline both times.

There are ways to resolve this problem, as two other states with early deadlines have already done. Washington state officials said they will accept a provisional certification of Biden’s nomination before the convention. And Alabama’s Legislature shortened its deadline so that Biden could qualify for the ballot there.

Neither solution seems likely in Ohio, where Republicans may be seeking to make life harder for the Democrats’ presidential nominee.

Now, Republican Secretary of State Frank LaRose has just send a letter to the Chair of the Ohio Democratic Party stating that he does not believe the legislature is going to grant an extension so the DNC is going to be forced to either change the date of their nominating convention to satisfy Ohio Republicans, or take them to court.

The Biden Campaign and the DNC has been largely silent on this issue, apparently attempting to resolve this behind the scenes through negotiations. However, LaRose's letter makes it clear that the time for a settlement to this appears to be at an end with Ohio Republicans prepared to force Democrats to take them to court.

It was my general understanding that the state parties are the ones that have ballot line access from the states. In this case the state of Ohio grants ballot line access to the Democratic Party of Ohio to place a candidate of their choice onto the ballot. There are, of course, party (state and national) bylaws that the party follows and the standard procedure is to submit the candidate nominated by the national party at the national convention.

What the Ohio party likely need to do is petition the DNC to submit a candidate before the convention meet the state's deadline and ask for a waiver from the national committee.

I only hope none of them ever graduate to Congress. We have enough obstructionist and rabble rousers in the House already.

Yup - that is modern day Democratic Leadership seems to be saying - capitulate to our demand's or we will go after you in court. Lawfare continues. It's not that difficult to follow rules - unless you think you are above the rules.

Let's hope we can remove as many Democratic members of Congress as possible. I don't think Joe's fall will be as drastic as Jimmy Carter #1 - but would be nice .

Ohio Gov. Mike DeWine (R) announced Thursday that he was calling a special legislative session to ensure President Biden will be on the November election ballot in his state.

“This is simply unacceptable,” DeWine said at a news conference. “Ohio is running out of time to get Joe Biden, the sitting president of the United States, on the ballot this fall. Failing to do so is simply not acceptable. This is a ridiculous — this is an absurd — situation.”

The special session is set to start Tuesday.

Let's hope the governor can get these knuckleheads in line.

Stung by their failed attempt last August to stymie the ability of Ohio citizens to pass a referendum enshrining abortion rights in the state’s constitution, and still smarting at the subsequent success of Ohioans in passing a ballot initiative that did exactly that, Ohio Republicans are now employing a strategy designed to prevent a repeat.

They are attempting to draft a new law restricting citizen initiatives such as the 2023 abortion referendum, in exchange for allowing President Joe Biden to be listed on Ohioans’ ballot this November. They are also attempting to condition Biden’s access to the ballot on passage of a law that would allow the Ohio Supreme Court to more swiftly impose new abortion restrictions.

Gov. Mike DeWine has sided with the Senate Republican ploy to score political paybacks as a condition to grant Biden ballot access

The devil is in the details of this disingenuous move which goes beyond banning foreign nationals (already barred from contributing to candidates and campaigns) with new requirements and hurdles intended to stop grassroots groups in their tracks. It is Huffman’s way to make it even more difficult for ordinary citizens to launch a ballot initiative — especially one opposed by the ruling class.

Also slyly folded into the compromised ballot bill embraced by DeWine was another “poison pill” that is also related to last year’s successful citizen initiative to enshrine the right to abortion in the state constitution. This one attempts to short-circuit the legal process governing lower courts that temporarily block enforcement of state law while it is being challenged as unconstitutional — like Ohio’s abortion law. It was put on hold pending resolution of lawsuits that argue it in violation of the Ohio Constitution after passage of Issue 1.

Rogue Republicans? This was a rule adopted in 2010. The state legislators were majority Democratic and the state senate was majority Republican.
