CIS notes that the secretive flights are 'legally dubious' and claim since CBP will not disclose the locations for fear of 'grave' consequences, it is likely not a program that should continue.
So the author does not know if the program is legal or not.

The ability to sway an audience and lead them toward the desired outcome without them suspecting or questioning the veracity of subject matter has placed us in a era when, as Cambridge dictionary postulates is post truth … people are more likely to accept an argument based on their emotions and beliefs, rather than one based on facts.
