Actually, yes it is. The first thing you do when someone hands you a gun is it prove and make it safe while maintaining trigger control. Had he been properly trained, and inspected it; no one would have been shot. He dropped the ball. Not intentional, but certainly negligent.

Very wrong, please understand that when you take a gun in your hand everything that happens while it is in your hand is your responsibility. If you are driving a car and run over someone you do not get to blame someone else, you were driving, the car was under your control.
