Yes it is. That is why he can release or not release it.

Except it's not, he can't, and he's about to get slapped with a subpoena over it.

Viva le difference! Can we both agree with whatever the court decides?

I'm in - you?

I would be if I believed your sincerity.

But if, as I suspect, you're only making the offer because Donald just asserted Executive Privilege on the Mueller Report, and you expect him to do the same for his tax returns (which, given his history of personal cowardice, he probably will), so the fix is in...

As long as I remember, I have heard, I have read that American democracy is resilient and we have enough “Checks and balances” in our form of democracy so no tyrannical power can sustain. But after past two years I realized “Checks and balances” only works if people who are in these position follow the form of government we hold dear past 200 years.

House democrat’s demand may be over reaching or not logical , but that is for another day to argue. The way our government is set up at the moment the congress is equal branch and they have the right to ask and demand what they deemed necessary. If we think house is over reaching their power, we can replace them in next election.

The most frightening part of what is going on today is that there are 45% of citizen who are willing to stump on constitution and the ““Checks and balances” of government just so their side wins. I just hope there will be enough people in next election who will re-think before they vote and ask themselves – do we want the kind of democracy we practiced last 200 years or give it all away. Because the way it is going now , 2-6 years from today we will not recognize the American democracy any more.

UPDATE: The Justice Department has now made up the rule! But nobody can see it.

The spokesman said the secretary is following a legal analysis from the Justice Department that he “may not produce the requested private tax return information.” Both agencies have denied requests for copies of the Justice Department’s advice to Treasury.

Perhaps more interestingly, WaPo has uncovered a draft IRS legal analysis. Although not final, it seems to indicate what the opinion from inside and bottom-up is, rather than orders from above.

according to the IRS memo, which has not been previously reported, the disclosure of tax returns to the committee “is mandatory, requiring the Secretary to disclose returns, and return information, requested by the tax-writing Chairs.”

The 10-page document says the law “does not allow the Secretary to exercise discretion in disclosing the information provided the statutory conditions are met” and directly rejects the reason Mnuchin has cited for withholding the information.

...of course the IRS already knows it is legally bound to turn over the records to Congress.

A confidential Internal Revenue Service legal memo says tax returns must be given to Congress unless the president takes the rare step of asserting executive privilege, according to a copy of the memo obtained by The Washington Post.

...according to the IRS memo, which has not been previously reported, the disclosure of tax returns to the committee “is mandatory, requiring the Secretary to disclose returns, and return information, requested by the tax-writing Chairs.”

The 10-page document says the law “does not allow the Secretary to exercise discretion in disclosing the information provided the statutory conditions are met” and directly rejects the reason Mnuchin has cited for withholding the information.

“[T]he Secretary’s obligation to disclose return and return information would not be affected by the failure of a tax writing committee . . . to state a reason for the request,” it says. It adds that the “only basis the agency’s refusal to comply with a committee’s subpoena would be the invocation of the doctrine of executive privilege.”

It's because they (the Democrats) need to have a reason, other than they hate Trump, to legally get them. The Mueller report did not help them and they are in terror mode.

The chairman of the house ways and means doesn't need a reason. Everyone else does. AND the returns are confidential so no one else can see them. So I am not sure what all these liberals are so anxious to see? They don't get to see anything.

Amazing isn’t it...?

Trump is the man who has gone from “I’d be happy to release my tax returns” to “I’d really like to release them, but I’m under audit”, to the man now taking legal action to prevent anyone from seeing them...!

What’s the fear Donnie...?
I don't think there is any fear at all. I think it's a battle of Will's here. Trump had been attacked from the left non-stop since his election. He's a fighter and not going to cooperate with those trying to attack him. That's his character. It's more along the lines of "you want this? You'll have to come and take it." It's not fear.

What's truly pathetic is that Donald won't voluntarily submit them. Nobody has done a better job making Donald J Trump look like he's guilty as heck & covering his tail than Donald J Trump.

Now as for the Mueller report, sure the folks who read the fortune cookie version of it written by Donald's handpicked sycophant think it makes him look like his as pure as the driven snow. Lol. Donald himself didn't even read it. Folks who actually did sure have told a different tale about it. If it exonerated him like he's claimed, well shoot it sure does seem like the 1st person to want Mueller to testify about it would be Donald himself. But nope.

I've read some of the report myself. The report clears Trump from collusion. It doesn't clear him from obstruction. It also doesn't recommend prosecution for obstruction. It is up to the justice department to investigate obstruction. So far it isn't. And quite frankly the Clinton investigation set the precidence for these investigations and prosecutions. If they couldn't prove Clinton obstruction they won't prove Trump obstruction.

Please....don’t use the words “Trump” and “character” in the same paragraph....

He is trembling with fear over what those documents will show about his corrupt business practices...

And New York State to the rescue. Fortunately, I believe that many of the schedules from federal tax returns had to be attached to state income tax returns. I know that I have had to attach different schedules to state returns in the three states I lived in that had state income taxes.

I applaud the NYS legislature (and Governor Cuomo, who said he would sign the bill) for having the courage and integrity that House and Senate Republicans lack.

Not counting the redacted Mueller Report, there are probably about three thousand page volumes of material from investigative journalists (also patriots) who provide plentiful national security reasons why Congress must see the president's returns.

But if you haven't read any--I've been reading them for several years--just ask yourself, "Would an innocent man act like a despotic dictator, as Trump does?"

God bless my home state.
