Man arrested for 'peace' T-shirt

According to the criminal complaint filed Monday, Stephen Downs was wearing a T-shirt bearing the words "Give Peace A Chance" that he had just purchased from a vendor inside the Crossgates Mall in Guilderland, New York, near Albany.

"I was in the food court with my son when I was confronted by two security guards and ordered to either take off the T-shirt or leave the mall," said Downs.

When Downs refused the security officers' orders, police from the town of Guilderland were called and he was arrested and taken away in handcuffs, charged with trespassing "in that he knowingly enter(ed) or remain(ed) unlawfully upon premises," the complaint read.

The war against dissent is going a bit to far.

I heard about this yesterday. How can you be tresspassing at a food court of a Mall, which is not a "private" place as the officer stated to which in fact was detemined to be a "public" place via a court decision some years ago. Not only that it sounds like they picked of all people, a lawyer.

Can you say lawsuit?

We often see threads on this forum about Christian students who were forced to refrain from wearing religious-themed shirts (or jewlery) at school.  And here we have a man being arrested for wearing a shirt bearing the slogan "Give Peace a Chance" in the very same mall that he bought the shirt from in the first place.

I'm sure those people upset with such cases will be completely outraged at this story!

Right?

I must live in the twilight zone. the only tshirts that are banned at our school are those with drugs alcohol sex themes. oh yes and the anti abortion one that had a dismembered fetus. If it had said abortion is wrong without the picture it would have been ok but I guess the picture was pretty gross.

I hope this man finds himself a good lawyer. This is the textbook example of an unlawful arrest. :(

It sounds like he is a good lawyer himself.  This mall is going to be sued without a doubt, I tell you what.

There has to be more to this story, but I highly doubt that he was arrested for wearing the t-shirt. Unless Guilderland has Fashion Police enforcing some sort Versace Act, there are no laws concerning attire that he could be cited under, much less arrested for. Most malls are owned and operated by corporations, so they are, in fact, private property. If a security guard acting on behalf of the owners of the mall asks a person to leave, and they do not, then they are technically trespassing.

While I don't agree with the over-zealous (and apparently ignorant) security guards, the statement that he was arrested for wearing the t-shirt cannot be true.

Yeah, my instincts tell me that there must be more to this story but I can find any extra info from the major news outlets. 

Hopefully we'll learn more soon.

Yes, you are right!!

If it wasn't from cnn I'd say it was nonsense.  This story definitely needs a followup.  The trespassing charge is like a blanket charge.  They must have asked/told him to leave and he refused, therefore the charge.  If it was just over the T-shirt, those two yokels and the mall should be made to pay.  But as others have said there may be more to this story.

HMMM. My opinion is the man was obviously stubborn. As a christian, I will stand for a conviction as a last resort when it cannot be avoided but picking a "fight" by refusing to leave and forcing the issue seems to me he was looking to make it the principle of the thing.
Am I the only one that see the irony and hypocrisy of passifists who are supposedly for peace but as soon as someone does them wrong they are all about their "rights' ? How do they think those "rights' are enforced? If not by courts who rule by force of law(violence if neccesary)
Perhaps this man is not a passifist and only against the war in IraQ or simply trying to make a point to give it a little more time. But my observation is he is a hypocrite since when faced with a situation that violated his"rights" he was not willing to back down but rather forced a confrontation.
If he cannot sacrifice his "right' to wear a t-shirt in the interests of making peace than how can he realistically expect peace to be given a change when the stakes are much higher???
How is this peace supposed to happen if both sides want their way and both wont back down? Seems to me the situation at the mall resembled the situation he is trying to protest. perhaps pride and selfishness and not wanting to lose when he thought he was right caused him to bring it to a point of physical confrontation? Is it just me that sees this irony???

I would say that the security guards picked the fight in this case.

O'Reilly had this guy on his show tonight. He sais he hasn't decieded to sue, cause he still has the charges pending against him. The only thing said that about what caused him to get arrested, was that an anti-war protest was held there in December.

But I still think it's horrible to harass guy whose was just getting some food.
