When Biden appointed her she was a magistrate judge on the same court for more than a decade, and before that spent more than a decade working for Kern (Bakersfield) County, California as a counsel. The whole point of this thread is that judges across the ideological spectrum and appointed by all recent presidents (including Trump) have ruled against his illegal actions.

Judge rules Trump executive order targeting law firm Perkins Coie is unconstitutional


In a 102-page decision, U.S. District Judge Beryl Howell ruled in favor of the firm and said Mr. Trump's directive that sought to punish it sent the message that "lawyers must stick to the party line, or else."

"Using the powers of the federal government to target lawyers for their representation of clients and avowed progressive employment policies in an overt attempt to suppress and punish certain viewpoints, however, is contrary to the Constitution, which requires that the government respond to dissenting or unpopular speech or ideas with 'tolerance, not coercion,'" Howell wrote.

She found that the executive order violates the First, Fifth, and Sixth Amendments to the Constitution.

So you "evidence" is from a self-admitted partisan hack *for* Trump. Good grief. One of the ways you can tell Mike Davis is a disingenuous hack is his reference to the Mueller investigation. -- The Chief Judge is *ALWAYS* the supervisor of *ALL* grand juries, and Mueller definitely had a grand jury, so *OF COURSE* she would be supervising it. SMH.

Trump Judge Orders White House to Return Deported Venezuelan Migrant (a different one)

U.S. District Judge Stephanie Gallagher, who was appointed by Trump, issued an order on Wednesday stating that the man's removal violated a previous court settlement.

Attorneys for the Department of Justice say Cristian is a member of the Venezuelan criminal gang Tren de Aragua and argued that because U.S. Citizenship and Immigration Services issued an "Indicative Asylum Decision" last week declaring that Cristian's asylum application would be denied, the order to return him should be dismissed.

"The Indicative asylum decision makes clear that if Cristian asylum application is more or less moot, his claim to asylum is moot," said DOJ attorney Richard Ingebretsen.

Meanwhile, the New York Times reports that Musk’s employees entered the nonprofit “with the help of Washington’s Metropolitan Police Department”, citing a phone call with Sophia Lin, a lawyer for the institute.

Per the New York Times: “Lin said that the U.S. Institute for Peace called the D.C. police on the Musk team members in an effort to stop them from trespassing because the institute has control of its own building and the land it sits on. But instead, the D.C. police allowed them to enter and kicked out the institute’s officials.”

Judge orders Trump administration to retain custody of Asian immigrants removed to South Sudan


U.S. District Judge Brian E. Murphy in Massachusetts ordered the administration to keep the individuals within the custody of immigration officials so that they could be returned if the court determined their deportation was unlawful.

“While the Court leaves the practicalities of compliance to Defendants’ discretion,” Murphy wrote, referring to the Department of Homeland Security, Secretary of Homeland Security Kristi Noem and Attorney General Pam Bondi, “the Court expects, that class members will be treated humanely.”

The order was in response to an emergency motion asking Murphy to intervene after attorneys learned two Asian immigrants [from Myanmar and Vietnam] held in detention in Texas, along with nine others, had been sent to South Sudan.

Murphy had already ordered the administration to halt any removal to any third country after it attempted to deport a group of 13 men to Libya earlier this month.

[South Sudan] is engulfed in armed conflict and the world’s third largest refugee crisis, according to the United Nations High Commissioner for Refugees. As of 2023, 2.3 million people had fled to neighboring countries and 2.2 million were displaced internally.

The Vietnamese man had signed orders to be deported back to Vietnam, according to his spouse.

“The detention centers are overcrowded with inhumane conditions and ICE is sending people anywhere they can to combat overcrowding. This is not right.”

The courts need to be cognizant of the separation of powers. The president has a mandate from the people and has been legally elected, not a thousand lower court wannabee dictators. This disastrous situation was created by a lawless government and to this day we don't know who was making the calls for Joe. Sadly there are still those within the Democratic Party who want as many illegals to stay as possible, giving little or no thought to the victims of some of these hardened criminals.

As I've explained, Supreme Court rulings of the past have made it clear illegals to not get the same "due process" as American citizens. The lack of due process given to Trump and those who support him during the last administration makes it hard for many of these objections to be taken seriously.
