Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

GLENDALE, OH (FOX19) - A 12-year-old boy is suspended from school for 'staring' at another student. It happened in September of 2014 at St. Gabriel Consolidated School in Glendale. The parents filed suit in Hamilton County Common Pleas court to try and get the suspension erased claiming the school didn't give their son due process.

A Judge denied the claim, which means as of now the suspension of the 12-year-old stands. "The perception is he intimidated her," said Candice Tolbert, his mother.

Fascinating inconsistency in taking offense. A man in another thread walks into a women's changing room where little girls also undress, he's not transgender but he takes advantage of the law that gives them special rights just to push the boundaries. No one calls police!
But this little kid in 2014 stares at a little girl and that's considered intimidating by those in authority over him and he's suspended. Which means this suspension and reason for it go on his permanent school record so as to make him appear to be weird in some way.

Wheres the ACLU on this one?
What a perfect opportunity to send this boy to a school with more sane teachers and staff.

The boy must have given something more along with that look. Having been a sub-teacher I can say that boys from fifth to eight grades can be a real pain in the , well you know. Junior High boys and girls are very stubborn and teachers that teach Junior High should get combat pay!

Exactly. Having taught that age group for over a decade, I can tell you that there is always more to stories like this. I have seen students and other teachers (and even I've been threatened with physical harm and sexual assault over the years) get threatened, intimidated, and assaulted by some students.

Even after a judge upheld the one-day suspension of a 7th-grader at a local Catholic school, the Archdiocese of Cincinnati says the incident has continued to be “widely mischaracterized.”

A lawsuit filed on behalf of the boy described the incident that led to the suspension as a “staring game." Social media posts and some media outlets have wrongly stated the races of the students involved.

Court documents say the 7th-grader was one of two boys involved in intimidating a classmate, a girl. The incident happened in September 2014 at St. Gabriel Consolidated School in Glendale. Both boys were suspended for one day.

The girl told the school’s principal she was approached during snack break by the boy whose parents filed the lawsuit.

According to court documents: “He walked up to her, said nothing, just stared at her… (She) backed away, and he continued toward her, continuing to stare, continuing not to say anything.” The second boy then “picked up where” the initial encounter “had left off.”

The parents of one of the boys sued the school, saying the school didn’t follow its own disciplinary policies.

The case went to a bench trial last week before Hamilton County Common Pleas Judge Patrick Dinkelacker, who ruled in favor of the school and dismissed the lawsuit.

Dan Andriacco, spokesman for the Archdiocese of Cincinnati, said the school’s handbook explicitly lists intimidation as conduct that may result in a suspension.

Andriacco also made clear that one of the boys is white and the other is black. The girl, he said, is Asian.

“It is highly regrettable that some have sought to introduce a racial element into a situation where none existed,” he said.

The attorneys involved in the lawsuit, Hallie Borellis and Donald Hordes, declined to comment.

Asians do have a different culture to non-Asians. Perhaps she was more intimidated than a non-Asian would have been. I don't know.

Interesting note here.. What authority would a judge have over a private school?

I have to wonder if a judge threw the case out because of a lack of jurisdiction and the media is reporting it as a victory for the school.

When you go to a private school, you voluntarily give up some of your civil liberties and you agree, in writing, to their rules.. and their rules are under no requirement to follow the public schools.

I was bullied mercilessly at that age. When my son was performing years ahead of his peers I waited until Middle School to skip him. If I couldn't take those years away entirely, I'd take away at least one year. My son is now grown and swears he will home school his kids when they reach that age.
