"Significantly, Merchan’s daughter has a financial or economic interest in her father’s case. She and her clients raised some $93 million in campaign donations by citing the Trump prosecution in their solicitation mailings, according to reporting by The New York Post.
On this basis alone, Judge Merchan was obligated to recuse himself because a member of his family —which is identified a child under strict ethical guidelines— has a private, vested interest in the outcome of the case. Yet, he refuses to step aside despite the glaring conflict of interest. Meaning, the fix is in."

We cannot continue to allow liberal justices to make a mockery of our Constitution. They need to be replaced.

Here is the opinion issued when they first asked him to recuse himself. It includes his reasoning and a letter from the Advisory Committee of Judicial Ethics explaining what his ethical obligations are. DocumentCloud

It is ironic to see members who have defended Clarence Thomas and John Roberts for not recusing themselves, when their wives worked for groups/businesses that had cases before the Supreme Court, criticize a judge for not recusing himself due to his adult daughter. So those who are directly gaining money are fine not recusing themselves but those who are not gaining money, since the daughter has her own home and separate finances, should recuse themselves. That seems an odd standard.

The NY Post is a sensationalistic and unreliable source.
Judge Merchan and others involved in Trump's cases are heroic and should be commended. They have had to live under heavy security in fear of their own personal safety due to the defendant's irresponsible attacks.
If Merchan issues gag orders it is not due to prejudice. It is a tempered reasonable response to wildly inappropriate behavior.

There is no standard unfortunately.

What is a Gregg Jarrett and why should we care about their opinion? Is it a legal scholar?

The name was vaguely familiar, so I googled: he has an actual law degree and did practice before becoming a talking head for Fox. He's full Magadonian.

WOW! Do you have things reversed or what!!! Democrats were demanding and the mainstream media inundated the country with cries for Thomas to recuse himself. I heard this for months. Now Thomas gagged no one, but here the leading presidential candidate is put on trial in election season and notes that the judge's daughter will be making a substantial amount of money on the case and thus asks for the judge's removal. And the judge puts out a gag order out! So the establishment gets to flood us with demands and stories (see below) for months, but now how dare the leading presidential candidate be allowed to say anything!

Legal ethics experts agree: Justice Thomas must recuse in insurrection cases

Ginni Thomas called 2020 a ‘heist.’ Clarence Thomas must recuse himself.

So how much money is the judge getting from his daughter? The rule your article is referencing has to do with, essentially, the nuclear family. So if a daughter who lives at home has a conflict, than it is considered a conflict. The author of the article knows that a daughter, who has her own life, house and finances, is not what was meant by "family members" in the rules.

Yes, Republicans claimed this wasn't an issue -- that a family member that made lots of money in a conflict of interest, money that directly impacts the finances of the judge (since spouses typically share income and, regardless, do share expenses), and that there was no reason for Thomas to recuse himself in any of the cases where his wife had worked for one of the parties. It wasn't just the insurrection, there were numerous cases where Ginny Thomas personally worked (through her firm), which increased the couples income, for the people with cases coming before the court.

Yet, despite the clear difference where one judge is actually financially benefits and the other just has a family member that benefits but does not benefit the judge -- you only have issues with the judge that doesn't fit; you instead make excuses and claim there was no reason for Thomas to recuse himself.

And, if we're going to be even about it, since Thomas did not recuse himself with a family member involved, why should Merchan need to recuse himself?

Trump vilified Merchan’s daughter with a combination of accurate information about her political affiliations melded with dubious claims about her supposed anti-Trump online posts, which the court says don’t even belong to her.

Trump pointing out accurate information is fine, it's the inaccurate information that is not fine and needs to be stopped.

Trump also peddled the discredited claimed that Loren Merchan posted an incendiary image of the former president behind bars on her social media account – an account that the court said didn’t even belong to her.

This is straight-up lying to the public and his supporters. He's once again lying to manipulate the public and the jury. It's also been shown in the past how his accusations have led to innocent people being threatened by Trump supporters.

She said that she abandoned that account and someone has taken it over. That's not straight-up lying, Joe and his people straight-up lied when they said the border was safe, secure, and closed because they knew it was not.

Again, the Democrat establishment went on and on, and now it's "How dare Trump mention the daughter." You know the press has been merciless against Eric and Donald Jr.., they paused after Chelsea Clinton stood up for Barron and waited until his 18th birthday and then began again to trash him. What hypocrites they are.

I think Republicans have lost all credibility with how they have used Pres. Biden's son and family. We have Project Veritas who published an alleged diary of the President's daughter, we have how they have tried to use the President's sons (including the dead one).

Now, I'm sure you'll say that they only use Hunter to investigate if there was wrongdoing by the President -- I'm sorry, that doesn't hold water when you have Republicans doing things like displaying nude photos of the son in Congress (zero to do with the President) or details about the son's drug addiction.

Last, judges aren't supposed to be political figures, they (as a general rule, though exception may exist) do not seek to be in the public eye. The family of a judge are not the same as the family of a politician -- since the judge is not attempting to be in the public eye (cases tend to be randomly assigned, not assigned because judges want them), there is zero reason for the judge's family to be public figures. If there were a real conflict of interest, as was claimed, it would be argued by Trump's lawyers in court. Instead, since there is no actual conflict of interest, Trump's posting seems to have no other reason to rile up his followers -- and that seems to be confirmed by Trump's posting of false information. Trump's posting is inappropriate even if there was a conflict of interest (again, something to be argued in court); that he isn't arguing it in court because it is not an actual conflict of interest, particularly with false claims, essentially makes it slander.

I seem to recall you being a huge supporter of Nicholas Sandmann suing the media (even though he lost any case that was adjudicated), but suspect you'd strongly criticize the daughter if she sued Trump for his slander.

Of course, he didn't simply "mention" her, he raked her over the coals.

Eric, Eric's wife, Don Jr. and Don Jr.'s paramour are all public figures by their own choice. Ivanka and Jared as well. I haven't heard squat about Barron other than his being tall. They were merciless towards poor Tiffany, too!

People were outraged when they found out Hunter didn't have to pay millions in taxes just because he was the son of Joe Biden. And it was discovered that the federal government was involved in a hoax, collaborating with the media, regarding the Hunter Biden laptop. Then we found out all of the suspicious financial activity reports on the Bidens that that had not been properly investigated. Not only had the government protected Joe Biden, but the government actively went after Trump and many of those who support similar ideas about making America great again.. Putin and a number of other heads of state go after their political enemies as well, but these violations of law at high levels in the United States are beyond anything in our history.

Which has exactly what to do with Hunter Biden's nude pictures? What reason was there to show them in Congress and on C-Span (will someone not think of the children!)? What about all the talk by Republicans about Hunter's drug addiction? Joe had nothing to do with Hunter's addiction, other than trying to get his son in rehab and off drugs. What about the alleged diary of Biden's daughter?

There is a huge double standard here, to the point you didn't address what I actually said and built a straw man (despite how I pointed what you would do). Are you going to answer my questions now or admit that Republicans have been equally bad?

No, Trump when he was president tried to go after Joe Biden and his family. Why were no charges brought by Trump's DOJ?

Donald is being prosecuted in two cases by the US DOJ and in two cases by local prosecutors. He was indicted by grand juries. He is being prosecuted according to law.

I spoke the truth. Hunter did not have to pay millions he owed, and people within the executive branch used taxpayer resources to make sure Biden was elected, perpetrating lies on the American people.
