Police officer walked into a man's home — mistaking it for her own — and kills him

Following the shooting death of Botham Jean by the hands of Dallas Police Officer Amber Guyger, multiple search warrants were executed at Jean’s apartment as part of the investigation.

One of the warrants became a public record Thursday afternoon when it was returned to the judge who signed it. It was shortly after Jean’s funeral had ended. It listed several items found in Jean's apartment, including a small amount of marijuana.

There have been several warrants signed by judges and executed in this case aside from the arrest warrant for Guyger and the search warrant signed September 7 that were returned to the court on Thursday. The others are still sealed and not accessible.

Like 90% of the people here I get my knowledge of how police investigations work via TV so... @Ana the Ist is that how this is usually done? Are search warrants needed for crime scenes like this?

Also making the fact they found weed the headline of the story is moronic.

That said, let's see 5 examples this year where a cop tried to illegally stop someone from recording. Lacking that, you're just blowing hot air. I'm asking for 5 out of thousands as you put it...so it shouldn't be too hard.

1. Omaha, NB

Police are assaulting Octavius Johnson for questioning a parking violation. His brother is recording the incident. The police order him to stop (unlawful order), and eventually, follow his brother into his house and destroy the video that his brother took. Fortunately, someone else was recording this incident. Over 20 officers on scene assisted in the violation of these people's rights.

https://www.wowt.com/home/headlines/County-Attorney-To-Weigh-In-On-Rough-Arrest-206271851.html

2. Citizen: "I am recording you."
Officer: "What are you recording? Let me explain something to you. You can go to jail for what you just did."
Citizen: "I believe the Supreme Court decision of Peck vs. …"
Officer: "Let me explain something to you. It is illegal for you to record a conversation without my permission and without notifying me."
Citizen: "I just informed you sir."
Officer: "You did not have my permission. And you just notified me AFTER you started recording the conversation.
Citizen: "No sir, I started recording right now."
Officer: "Do you want to argue about it? If you want to argue about it, you can go to jail."
Citizen: "No sir, I don't want to argue about it."

3. Wilmington, NC. Officer tells person he could go to jail for unlawful recording. There was no law against recording.

4. Officer tells citizen he can't record because he's not involved. Unlawful order.

5. Woman arrested for legally recording officer. Claims that the woman is committing a felony. Officer says "I know the law better than you, believe me."

6. Woman arrested for legally recording officer. Spends the night in jail despite legally filming the officers. "I know the law better than you, believe me." (is this something officers are taught to say?)

http://www.youtube.com/watch?v=ZzAcCARmSmU

7. Officer threatens to confiscate phone for recording the police.

http://www.youtube.com/watch?v=cKG0ftKvmao

8. "If you record me, i'll arrest you."

http://www.youtube.com/watch?v=aQ0AiBV-XxA

9. Baltimore. Man records officers arresting. "You gotta go" "1...2...3...and you're going to jail." An investigation into Baltimore PD for illegal suppression of citizen rights to record was already in progress and they're still doing it."

http://www.youtube.com/watch?v=rciIrgJJENs

10. Pittsburgh. Officer approaches journalist video taping while carrying a baton. He yells at the journalist claiming that they're "causing problems". For good measure, he smashes his baton into a metal pole on the street as he walks away.

As an added bonus an officer with a baton shoves a young schoolgirl crossing the street.

On the plus side, the officer didn't claim that recording them was illegal. He just wanted to intimidate the person.

Oh, wait. You wanted 5 examples, I accidentally provided too many.

There are plenty of other examples readily available.

The police are recording citizens without their permission so why can’t citizens record the police? This should be considered not allowing citizens to provide evidence. The police should have absolutely nothing to hide so there should be no reason a person cannot record the conversation with a police officer as it usually results in going to court.

I couldn't tell ya. I don't see anything unusual about it, but I'm not intimately familiar with Dallas PDs procedures.

Warrants will be applied for everything, otherwise the prosecution might find evidence excluded. It’s called covering ones back.

It would be news if it belonged to the shooter, the list of items found does not differentiate as to whether the items are the victims or the cops.

Drug test the victim -- not the killer.

Just in case you were wondering why people kneel for the anthem...

The Photography Is Not a Crime page has tons of examples, including many from this year. I'm not going to link to any of it because even the captions are loaded with profanity, but google "Photography Is Not a Crime" and hit the "War on Photography" link at the top.

Your first example is from 2013.

You asked for 5 examples of cops trying to illegally stop someone from recording.

All the time huh? Arguably, as cops face unknown territory whenever technology changes. Prior to 2005, not too many people had cameras in their phones. So naturally, there's going to be a period where rights need to be legally defined.

That said, let's see 5 examples this year where a cop tried to illegally stop someone from recording. Lacking that, you're just blowing hot air. I'm asking for 5 out of thousands as you put it...so it shouldn't be too hard.

You said nothing about date. I provided 10 examples, and you responded with "the first example is from 2013". I knew that providing the examples you requested wouldn't advance the conversation, but I'm surprised that you didn't even attempt to address the evidence presented.

9th from 2012.
1st, 2nd, and 8th from 2013.
5th and 6th from 2014
4th and 10th from 2015.
3rd and 7th one is from 2017.
So, now that we've established that you've moved the goal posts, i'm guessing that these examples need to also happen on days ending in "Z".

1. 2017

2. 2018

10. 2014 - but video only released in 2018

I'm not sure why I posted another 10 examples (now 20) when I know you will find any excuse to dismiss the evidence of police illegally ordering people to stop video taping.

Sorry, I must've gotten confused with your garbled sentence structure. Presumably, if you were versed in writing English, you would have written "let's see 5 examples from this year", but we'll let it slide since you're such a "smart guy"

And I've provided 10 from within the last 12 months. (even though you actually asked DGI for them).

Yet, still no acknowledgement from you regarding the actual substance. (shocker!)
And now you've got 10 from this year... care to push your luck and ask for 10 from the last month?

Since you guys both want to get into the meat of this...I found these rulings which seem to be of import to the situation.

https://en.m.wikipedia.org/wiki/Glik_v._Cunniffe

Which establishes the right of a 3rd party in public to record police...under some circumstances...but as one's vehicle isn't "public", it obviously wouldn't apply to those situations.

And this....

https://krcgtv.com/news/local/eight...ve-a-right-to-film-public-officials-in-public

Which seems to contradict the first ruling...and was scheduled for the SCOTUS but I couldn't find any rulings on it. That's from about a year ago.

So to be honest...I've got a little bit of trouble sorting out when one can and cannot legally record police. That late 2017 ruling was the most recent one I found...and if you guys have anything more current, I'd like to see it.

I mean, even if you just skimmed it and didn't really read the point I'm making...you would agree that if you're going to complain about something being a problem now, you can't really back up that complaint with examples from 5 years ago...right?

That makes sense to you...doesn't it???

Again, you realize that you had the other conversation with DGIHarris, and I replied to a specific point of a post in the thread, correct?

I read the thread before posting, but overall, I read it fairly quickly. The thrust of "it's a problem right NOW" wasn't imparted to me so much as "it's a problem that continues to be a problem".

You understand this, don't you?

"The results — if the tests have been completed — have not been made public. "

You got any evidence to share?

You got any evidence that those tests were started, let alone completed?

Meanwhile, we know more about the 10.4 grams of marijuana on the kitchen counter than what was in the killer's blood.

Why is that?

I'm sorry...what are you asking? If I have personal information about the blood testing lab, and whether or not they started the tests for this case?

Let's say I don't...as I imagine nobody here does lol...what exactly does that prove?

Here, maybe this will help...

https://communityimpact.com/austin/...dallas-forensic-lab-address-rape-kit-backlog/

It's an article about the Dallas forensic labs agreeing to help the Austin forensics lab with a backlog of 700+ DNA evidence from mostly sexual assault cases stretching back into 2014! Such is the unbelievable rate of crime in this nation...it often outstrips our police resources.

So I'd say it's entirely likely they haven't gotten to the case that happened last week....but don't let that stop you from painting them in the worst possible light lol.
