The Torah is a deadly thing if there are no definitions! We can say that someone who coughs has violated the sanctity of Shabbat, since coughing is caused by germs - and germs are unclean. How can you know?!?

In principle, I agree, there must be definitions, but the example here is crazy. There is a limit to what people can accept. Moses would never give people a law they couldn't accept.

If you believe he or someone else just kind of invented these laws, and that their origin is not in revelation from God, then that principle is even more true. Like Muhammed, Moses (or one or more people who equate to him) could from a secular perspective be seen as a codifier of existing traditions. Hence, a crazy thing like killing someone for COUGHING would have to be derived from the crazy praxis of a crazy people. The praxis would have to be acceptable to them to begin with, and such a crazy idea simply is not. From a secular perpsective, the praxis would have to emanate from the people, and the Prophet would just codify it. Even to the extent the Prophet is original, what he comes up with must still be congenial to his audience.
