Sickening. I don't know how that judge can live with himself for ordering that baby be given back to the mother. With some common sense, she would be alive today.

The child died because of the fathers vigilantism; had he gone to the cops and told them about the meth lab, they would have busted down the door the same day. Then the mother would have lost custody. INSTEAD this yahoo decides to take the law into his own hands and kidnapped a child that he did not have legal custody of. The judge was following the law, his hand was forced by the reckless and irresponsible actions of the child's father.

It's not pretty and it's not heroic but the truth is, if your daughter is in danger from her meth addicted mother, you have to go to the cops.

um, no, its not that easy. you can't just walk up to a cop, tell him there's a meth lab at such and such a place, and expect him to break the door down. it just doesn't work that way.

Actually it really does. I was thinking more of a police station, but I guess a beat cop would work just as well. The cops can't just search your place for no reason but if you can describe what is going on in the house, they'll go out and take a look see. Cops would rather infringe on your rights a little and get the case thrown out later than let a kid die.

Wrong. Peoeple don't always act rationally when their family is in danger. This guy isn't a "yahoo", he's just a normal guy.
The child died because the judge who ordered the child back into his mother's custody was an idiot.

They should be able to sue the judge for professional negligence.

So because his child is in danger he can kidnap her? He didn't have custody! Should every father who doesn't have custody of his child be able to just take the child whenever he wants to?

We have laws for a reason, the child's death is the father's fault. If he had followed NORMAL channels the child might be alive today. Because he decided to ignore the law and break into the home, there is NO WAY the judge would order police to investigate the house. Why should the judge use the police to help a father with no rights to the child harass the mother? The meth-lab story sounds like an attempt to smear and harass an ex-lover. This entire situation is different if he does NOT break the law and kidnap his child, then his story is believable.

Go to the cops, if they will not help, go ahead and break in, burn the place to the ground for all I care, but go to the cops first.

If you are being chased by an armed man – can you break the speed limit ?
His child was in danger. He absolutely can break the law to retrieve her from that danger.

If those children were living in a house being used by drug gangs as a meth lab – absolutely.

No. The death is the fault of the following people :-
i) The judge for ruling that the child should go back
ii) The mother for keeping her child there
iii) The person who gave the child the overdose of an illegal drug.

Not every Judge does the right thing even if they have the evidence. We had a foster child that was sent home, she got into trouble and I had to pick her up at the police station the mother told the judge that she could not handle the girl, and wanted her back in foster care in my home. The judge told her she needed to figure it out and take her home. Two weeks later the girl was dead from a drinking related incident. The mother ask for help gave them evidence and the judge refused to believe her. This kid was a danger to herself and that judge wouldn't listen. So sometimes a parent tries to do the right thing and gets shot down. I know this for a fact

If the child is living in a Meth lab, sure.

We have laws for a reason, the child's death is the father's fault.

Actaully is the fault of the Judge, the mother and the mothers boyfriend along with anyone else who knew the baby was growing up in a meth lab and didn't do anything about it.

This may surprise you, however normal channels don't always work, especially if your a minority, poor and/or uneducated.

The meth-lab story sounds like an attempt to smear and harass an ex-lover. This entire situation is different if he does NOT break the law and kidnap his child, then his story is believable.

You might run to the police, I would run to a lawyer, however this man only knew to run to his child and to remove her from danger. The Judge didn't take the time to understand the situation and simply followed the letter of the (negligent homicide IMO) and returned the child to the meth lab from which it had been rescued.

Go to the cops, if they will not help, go ahead and break in, burn the place to the ground for all I care, but go to the cops first.

I have the attitude and mindset that the cops are there for me and therefor I have no problem going to them with a problem. I have the power to retain a god lawyer, I am not helpless before the law. This is not the condition of most people who are working class and below. From that perspective what the Father did was perfectly reasonable.
