Federal grand jury indicts Mexican man acquitted in Kate Steinle killing on new charges

Each of the the two new federal charges carries a maximum of 10 years in prison if Jose Ines Garcia Zarate is convicted, the government said. He was indicted on one count each of being a felon in possession of a firearm and ammunition and being an illegally present alien in possession of a firearm and ammunition.

The killing of Steinle became linked with the controversy over illegal immigration, and President Donald Trump referred to the case in pushing for stricter policies and in criticizing so-called "sanctuary cities."

I'm so glad Republicans are above politicizing the DOJ.
When a guy admits to unjustifiably killing someone and walks away with a slap on the wrist for illegal possession of a firearm, it's time for the DOJ to step in and see to it justice prevails.

When a guy admits to unjustifiably killing someone and walks away with a slap on the wrist for illegal possession of a firearm, it's time for the DOJ to step in and see to it justice prevails.

He said it was an accident and that the gun was wrapped in a t-shirt.

Somebody let me know when the Trump/Sessions DOJ jumps in this quickly to slap federal charges on a cop acquitted of killing an unarmed civilian.

I do remember. I specifically referred to the "Trump/Sessions DOJ" because I don't have faith in that pair to act as a backstop against certain kinds of injustices the way that previous DOJ's have.

Also, this DOJ actually acted more quickly against Jose Zarate than the Bush administration did against the LAPD officer. The LAPD officers were acquitted on 4/29/92 and the feds started presenting evidence to the grand jury on 5/7/92 - a span of 8 days.

Jose Zarate was (mostly) acquitted on 11/30. The feds issued an arrest warrant on 12/1 and the indictment came out on (or before, I'm not sure) 12/5 - a span of 1 or 5 days, depending on how you want to count it.

He was already tried for this and found guilty. ??
He was, but on state charges. Double jeopardy doesn't apply if there are two different jurisdictions involved. In simpler terms, you can be tried for the exact same crime in both federal and state courts.

Yep, so he’ll be potentially serving two sentences for the same crime.

Voluntary manslaughter and involuntary manslaughter were both charges that the jury was given the option of charging him with.

Because of rules against double jeopardy, Zarate cannot be tried for the same crime twice, but the Department ohttp://www.theblaze.com/news/2017/12/01/department-of-justice-issues-arrest-warrant-for-illegal-alien-acquitted-of-kate-steinles-deathf Justice can arrest him for other charges.


The DOJ is amending previous charges in light of Zarate being convicted of felony possession of a firearm in the Steinle case. According to DOJ prosecutors, they believe they can prove that this in violation of probation ordered against Zarate in 2011 on one of the five occasions he entered in the country illegally.

Yep, so he’ll be potentially serving two sentences for the same crime.
That would be double jeopardy BUT it doesn't appear that they are charging him with the exact same crime.

It appears that the feds are charging him with possession of a fire arm and ammunition in violation of a 2011 probation. Which would be a different charge.
