Senate President Karen Fann said the audit report on the Maricopa County election will be delivered to the Senate at 1 p.m. Sept. 24 in a public presentation on the Senate floor.

This delay gives me time to buy popcorn this weekend. The Cyber Ninjas best not disappoint me.

“They are planning to release the final report a week from tomorrow,” Langhofer said, adding that the Senate does not yet have a draft from Cyber Ninjas, the Florida-based company contracted to oversee the audit.

Maricopa County Recorder Stephen Richer is asking Arizona Attorney General Mark Brnovich to investigate after voter registration records were posted online.

Voter registration records known as the “voter file” are available to the public, but it's a felony to publish the information on the internet. The voter file includes the name, address and party affiliation of registered voters, along with some phone numbers. It shows whether the person has voted in recent elections but not the candidates and issues they supported.

“It appears that in this case, information from a public records request may have been posted in violation of state law,” Richer said in a statement Thursday. "I trust the Attorney General will look into this and take any necessary action.”

In August, a judge ruled that Cyber Ninjas must turn over audit-related documents by mid-September, following a pair of public records lawsuits from the Arizona Republic and the transparency group American Oversight.

But despite the judge upholding that ruling last week, Cyber Ninjas has not complied, stating that it might release some documents after its audit report this week—and in some cases, maybe never at all.

Wilenchick objected to the court order on two grounds: that Cyber Ninjas should not be subject to public records laws, and that Cyber Ninjas is too busy to release court-ordered records (which a judge ordered Cyber Ninjas to preserve in August).
