    Sidney Powell argues in new court filing that no reasonable people would believe her election fraud claims - CNNPolitics

    In a new court filing, Powell's attorneys write that she was sharing her "opinion" and that the public could reach "their own conclusions" about whether votes were changed by election machines.

    "Given the highly charged and political context of the statements, it is clear that Powell was describing the facts on which she based the lawsuits she filed in support of President Trump," Powell's defense lawyers wrote in a court filing on Monday.

    "Indeed, Plaintiffs themselves characterize the statements at issue as 'wild accusations' and 'outlandish claims.' They are repeatedly labelled 'inherently improbable' and even 'impossible.' Such characterizations of the allegedly defamatory statements further support Defendants' position that reasonable people would not accept such statements as fact but view them only as claims that await testing by the courts through the adversary process."
    This is pretty comical. So, she's basically throwing about a third of the country under the proverbial bus and implying they are not "reasonable people" since they believed it and hung on every court filing related to it with no reward in the end.

    I thinks she's both right AND needs to be charged because of it.

    At least she makes her feelings about some posters here on Christian forums pretty clear.

    If it's the case that she cannot be believed by reasonable people (a point where she and I agree), then I'm not sure why she should continue to practice law. Maybe her state should consider disbarment.

    Yes, it is one of the odd things to me. Despite being let go by the Trump campaign staff, precisely because she kept pushing this conspiracy theory with no evidence, she still chose to file suits in various states using the claims she says shouldn't have been believed by a "reasonable person." It does raise the question that, if her lawsuits were that frivolous, by her own admission, then why she should not face sanctions?

    IIRC there is a separate case in Michigan which would result in just that - and this brief runs counter to her interest to win in that separate case.

    Noting that the thread title is incorrect ... as often seems to be the case with CNN "stories".

    Instead, Sidney Powell's lawyers argued that that is the claim being made by the plaintiffs. It seems that in regard to the accuracy of Sidney's actual statements, the OP said this: "Given the highly charged and political context of the statements, it is clear that Powell was describing the facts ..."

    We'll have to wait and see if Sidney sues CNN for defamation. One doubts that CNN would ever correct their headline regardless of what facts are subsequently made manifestly obvious.

    Is it OK to tell outrageous lies about people and organizations if you're only trying to fool unreasonable idiots?

    The law as far as I am aware merely requires that the claims be false and damaging, and that the person making the claims knows that.

    Then, the lawsuit should be thrown out ... because Sidney Powell has not changed her position.

    The claims she made, the ones that no reasonable person should believe, are not based on facts, though. They're just claims. No one has shown that Dominion machines have miscounted, changed votes, were hacked, or anything else. There are no facts to support her claims.

    Incorrect. You should read the forensic report for Antrim county Michigan where thousands of votes were incorrect because of Dominion machines.

    Even now, Antrim officials "unanimously" refuse to use Dominion machines, and have gone back to hand counting.
    Antrim County eschews Dominion equipment in favor of hand count for primary ballots

    Commissioners in Antrim County rejected a request last week from the chief election officer, who sought $5,080 to hire consultants to prepare their Dominion machines for the May 4 contest, and voted unanimously to keep the equipment "on ice," according to the Traverse City Record-Eagle.

    Antrim County Clerk Sheryl Guy, who issued the request, said the machines were not "certified for use" as required by the Michigan secretary of state because of a forensic examination conducted in December as part of the November election lawsuit against the county

    The forensic report done by a man who claimed part of the fraud in Michigan occurred in counties that are actually in Minnesota? The one who claimed there was digital adjudication of the ballots on Dominion machines, when in fact adjudication is not done on the machines? Basically, a report made by a Trump supporter who had no clue how election systems work and created a report alleging there was fraud, but what it really showed is his own ignorance?

    Also, there is the fact that the hand count of the November ballots in Antrim county matched the count by the Dominion machines.
