Probably because it's utter nonsense.
Assuming that the woman in question is trying to get pregnant and has unprotected sex during her most fertile time -- about 2 days before ovulation -- she has about a 20-25% chance of getting pregnant. An other time in her cycle, and the chances drop considerably, to about 5%
And we're not even taking birth control into account. The various BC methods out there -- ranging from pills to prophylactics -- have a 95-98% effectiveness rate... which means even on those rare occasions when they do fail, the woman is still only looking at a 5-25% chance of pregnancy.
So... sex does not = pregnant. How this is like mystic wisdom only a few understand is, sadly, all too easy to realize... the state of sex education being what it is.
I am so glad you said "that being said..." as the premise of your argument has been shown to be false, the remainder of it can be round-filed without much difficulty.

Doubtful. Whike a few might think twice, others would consider it prudent to kill their victims to prevent them from accusing them. A man already facing death has nothing left to lose.
That said...
It is not the severity of punishment that deters crime, it's the certainty. If you could guarantee that every rapist would be caught, convicted, and sentenced, that would make it happen less often.
