A New York judge on Tuesday temporarily blocked the publication of an unflattering tell-all book written by President Trump's niece that Simon & Schuster is set to publish in July.

The ruling, issued by Judge Hal B. Greenwald of the New York State Supreme Court, the state's trial court, is the first legal win for Robert S. Trump, the younger brother of the President. Robert Trump has sought to block the book by Mary Trump, the President's niece, contending it violates a confidentiality agreement related to the estate of the President's father, Fred Trump.

Adam Rothberg, a spokesperson for Simon & Schuster, said in a statement that the company was "disappointed" in the court's decision.

"We plan to immediately appeal this decision to the Appellate Division, and look forward to prevailing in this case based on well-established precedents regarding prior restraint," Rothberg said.

I'm surprised it got blocked. A prior restraint is almost unheard of.

The Right in this country is increasingly eager to crack down on speech when it's not favorable to them, it seems. The case of trying to get the Justice Department to block the publication of John Bolton's new book comes to mind as well.

Oh no. That's a classic Leftist move to shut down speech it doesn't like, as on college campuses, whenever a speaker comes they don't like. Instead of just ...not go hear the speaker (duh) - students protest and sometimes damage buildings in order to prevent other people from hearing the speaker.

Get your facts correct before jumping to some irrelevant 1st Amendment issue. This is a contract law case, plain and simple.

The President's brother Robert filed the suit. Mary is the daughter of the late Fred Trump Jr. It's just a preliminary injunction, which you can read here. NY Court Blocks Trump Niece From Publishing Her Book

If you sign Nondisclosure Agreements in order to receive a benefit, you can't later write a book or speak publicly on the topic - that is exactly the right you gave up. Pharmaceutical companies, for example, require these all the time, when their products cause injury so the company settles. NDAs are widely used.

Fred Trump Jr. died in 1981. It's no surprise that she waited to release what is intended as damaging information immediately before the election. Another classic move.

There was a Nondisclosure Agreement, signed by Mary Trump (and presumably all heirs). This is why it was blocked. You cannot agree contractually to receive benefits in exchange for keeping your business private, and later violate that for money (or fame or anything).

The NDA must have a clause for penalties if it's violated. It doesn't take away anyone's First Amendment rights.

Still almost unheard of. She can be punished for violating the NDA, but the Supreme COurt has held that prior restraint can only happen in very unusual cases where "irreparable harm" will happen. Also, the NDA applies to Mary Trump, not her publisher.

Appellate court "lifted a temporary restraining order against the publication of a book by President Trump’s niece, enabling publisher Simon & Schuster to continue printing and distributing the explosive insider account by Mary L. Trump."

In the ruling Wednesday, Scheinkman noted that the confidential agreement barred each side from disclosing the terms of the settlement or “publishing any description of the litigation or their relationships” without the consent of all parties. Although Mary Trump had agreed in that settlement that she or her agent could be subject to penalty if it was violated, Scheinkman said he did not find that Simon & Schuster qualified as her agent because it was not party to the original agreement.
