Judge Orders Government to Fully Reinstate DACA Program

    Not an election topic. A federal judge in NY has ordered INS to abide by the DACA guidelines. This is only at the district level, so it will definitely be appealed. But as of now, it’s another loss for Donald Trump.

    So much winning. :doh:

    Unelected officials running the country? Not a good idea.

    But when elected officials violate the law, they must be restrained. That’s the reason we have checks and balances.

    The Supreme Court also ruled on DACA this summer. Under the outgoing president's administration, the program had stopped accepting new applicants, and so there were many 18-20 year olds who had no memories of their birth countries and only knew about their life in the U.S. who could not apply. The Supreme Court also said that making DACA youth reapply every year instead of every two years was both costly in terms of fees and time but also unnecessary.

    That won't happen. But I suspect that law enforcers will continue to step outside their role and try to be law makers.

    Sure, no one should be above the law, including those elected to govern. But there is an awful lot of interference from the judiciary. If the president makes a bad law, he can be fired by the public. Judges are not under that threat.

    Our current President is trying to move heaven and earth to get the judiciary to interfere in the election.

    Strictly speaking, the President doesn't make laws. Congress does that. The President's primary job is to execute the laws made by Congress. And pursuant to that, whatever executive orders he issues are supposed to enable and assist the various federal agencies in carrying out this task. The bolding is because EOs may sometimes exceed their authority. It's not just a Trump thing--it's become an issue with every recent President. And it arises largely because the intense ideological divide in Congress (which reflects the entire country) makes workable legislative compromise almost impossible.
