do you own the book? are you selling or giving away the pictures without permission of the author?

Is the publisher/author/owner giving permission? or has the book become free because it was written so long ago?

In #1 I don't own the book but the school gave it to me, and I'm giving my friend the pictures because he "can't" afford the book

In #2 some random person, just put it online.

No permission is granted on either one.

then yeah. technically that is considered pirating. which is a form of theft. :(
as a college student I understand the money issue. you and your friend should rent the book for 30 dollars or so. you'll never use it after the class and that price is affordable. :)

1. Is it theft to take a picture of each page of the book?

2. Is it theft to use an online book, that does not belong to the original creator?

"FAIR use" is, practically speaking, for your own use and / or not for profit.
If you profit from the use of others material, you are open to trouble.
You can use others material if substantially altered.
So you can quote quite a bit under "fair use".

Alright I agree with fair use, but then is music another ball game right? Because it's technically using the music without profit.
