It will be interesting to see if four Republican Senators will join the Dems and/or if Manchin of WV will switch and vote with the Republicans. If Manchin does switch, then there must be five GOP Senators go along with the Dems to pass the measure.

Whats sad is people hate Trump so much that they don't research the subject of illegals coming here. They just believe the bias news that its being factual. Politicians who sit in DC are telling people its not a big deal.

But if you talk to ACTUAL people who live in border cities on the US side, they will tell you things are getting worse every year. More and more people cross illegally and the patrol just can't catch them all. Many citizens have moved out as the cities are getting worse to live in. Gangs, drug dealers....etc.

Heck one of the prisons in Arizona (if I recall right) said over 70% of their population is M13 (the gang). Ask the police and ICE how many bodies they find on our side with cut off limbs, heads...etc because of M13.

For now people will be oblivious to this because they don't see it happening in their backyard. Remember that when a family member gets killed by a gang member just for existing.

Good. Now if enough Senate Republicans can grow a spine to pass the law, this would be a stinging rebuke. Even better if Republicans could find the courage to form a veto proof voting block.

An American Caucasian citizen killed a police officer in a hit-and-run over the weekend. Americans are killing Americans every day! Wake up, people we need a wall to keep Americans from driving around killing Americans!

Grow a spine? I think you mean become spineless. That would have to be the outcome to side with those Dems. It's bad enough we have one party trying to make it unsafe for both the grown and pre-born, we certainly don't need two.

Honestly, Americans who kill Americans don't have the option of returning across the border to escape justice.

People are crossing the border illegally. People in government do not want to stop them. That is the issue. If those people in government do not like the law they should change it. It's just that simple.

Less texting while driving and less driving under the influence would help.

The “spineless” are those not voting for the resolution. Trump has exploited a lawful loophole and his motive is because, in part, Congress refused to allocate the requested funding amount for his border wall.

And voting for this resolution has absolutely nothing to do with the tangential, no red herring, of the “pre-born.”

That’s not really the issue in this thread though.

The issue in the thread is Trump declaring an emergency and a goodly amount of people in the Congress oppose it. If they vote to oppose it Trump will veto it. The Congress will not have the votes to override the veto so they'll try to overturn it in court.

There is no legal reason to overturn it and it will be declared a political issue. Trump will spend the money on a wall -or whatever- and it will be front and center in the 2020 campaign.

No. First, there is the issue of declaring a national emergency and then the issue of which statute he can invoke for funding. Trump may have the statutory discretion to declare an emergency.

However, the applicable and relevant statutes he can rely upon under an NEA for funding afford him significantly less discretion, in there specific conditions to be met for funding such that the applicable and relevant funding statutes he is likely to invoke are not susceptible to the Political Question Doctrine.

Of course, this legal digression aside, we are still left with the propriety of Congress voting to end the emergency.

Texans solidly against Trump's decision to declare a national emergency

The first is improbable, the second -- not a chance.

But on the plus side, it's requiring the GOP who support him to go on the record as Donald's loyal lackeys... knowing full well that Donald's just going to declare emergency after emergency to get the rest of the money for his wall (as well as whatever else he wants to raid the coffers for the rest of his term).
