In order to avoid legal trouble regarding the so-called "emoluments clause" of the constitution (art 1, s 9, clause 8: receiving no gift, emolument, office, or title from foreign state), President Trump said that his companies would donate any profits from foreign-state guests at his properties.

This letter is from the Oversight and Government Reform Committee's ranking minority leader Elijah Cummings (D), challenging the Trump organization's compliance with this promise.

Summary from official letter:

  • Only produced and distributed a pamphlet to Trump organizations, totalling 40 sentences
  • Has not produced any records of procedures put in place to capture and distribute these profits to treasury
  • Has not identified whether Trump org plans to label these profits as donations to the Treasury for beneficial tax purposes
  • Trump org describes requirement to identify foreign state guests (direct and indirect) as impractical, and would diminish "the guest experience of our brand"
  • Trump org's initial standard only captures direct state guests, and not state sponsored guests, or individuals receiving reimbursement
  • Trump org describes the requirement to identify specific profits tied to foreign state transactions as "not practical, and nor would it even be possible without an inordinate amount of time, resources, and specialists"
  • Trump org has made no efforts to comply with a briefing with oversight committee, which was requested in April 21 bipartisan letter

  • Informative
