From the "Dominion Voting Systems should sue!" files: Dominion Voting Systems Demands Sidney Powell Retract Election Fraud Statements

“We write to demand that you retract your most serious false accusations,” the letter continues.

The letter cited Powell’s claims of Dominion’s ties to Venezuela and late strongman Hugo Chavez, as well as claims that “Dominion paid kickbacks to Georgia in return for a ‘no-bid’ contract to use Dominion systems in the 2020 election, and that Dominion rigged the 2020 … election by manipulating votes, shifting votes” and “installing and using an algorithm,” according to the law firm. Powell should retract such statements, they added.
...
And these assertions, the firm said, also “exposed” herself and the “Trump campaign to substantial legal risk of defamation,” according to the letter. “We demand that you immediately and publicly retract your false accusations and set the record straight,” it also said
.

One can't help but wonder what took them so long.

One also wonders why they haven't already filed a lawsuit.

One suspects one already knows the answer to these largely rhetorical questions.

Speculation isn't evidence.
One wonders how many law firms Dominion Voting Systems had to contact before they found a firm with attorneys who knew so little about Dominion that they were willing to take the case.

...because in the real world, plaintiffs normally give the other party opportunity to respond or in this case, retract her false accusations.

How long should we wait for Dominion to file a lawsuit?
Actual lawyers, unlike the Kraken-type, a reasonable amount of time is allowed after sending a Cease-and-Desist. That's how actual lawyers work. This pause can lead to the two parties cooling off or resolving a conflict. Actual lawyers.

<shrug> that's up to them. Rushing into a lawsuit is rarely a good step.
I suspect that Sidney Powell might say that going forward with any lawsuit is a losing proposition for Dominion. Just a guess though ...

From what I gather, Dominion would have a tough case if they did indeed sue. Not because Powell is right, but because it's just hard for them to prove the things they would need to prove for Powell to lose.

It's just pro forma. One can hardly believe that Dominion could really consider itself defamed by someone too irrational to take seriously.

Lawyers are not required to be ignorant in order to take a client's case -- you're thinking of jurors.

Well, they do have a good argument that her claims are causing the company harm. The issue is what the threshold is for defamation is for them, and if they can prove it. Does she really believe what she claims despite being wrong? Or does she know she's wrong but repeating them anyway?

In Powell's case that would be an extremely difficult question to answer.

Well I suppose it's a good thing that Trump did not keep his promise to loosen up libel laws or else she would have already been sued.

Why are you waiting? Neither Dominion nor anyone else is required to do anything on your schedule...

So, one might conclude then that Dominion is merely posturing ... in hopes of salvaging some monetary measure from this unmitigated disaster for them ... and that Dominion knows better than to actually file a lawsuit.

On the other hand, reports indicate that China has poured nearly half a billion dollars into Dominion, so they might actually attempt the lawsuit gambit. We'll see.
