I don't know, but maybe you can scan in two sides of a leaf (next to a ruler) to query experts on the matter.

(edit: Is that a picture of your tree? The OP said that it was close to the street.)

Could be a walnut or butternut tree. If it is remove it immediately. They are relatively fast growing, and very messy when they produce nuts. We are removing a large black walnut tree that overhangs our parking lot and messes up the parked cars. The falling walnuts have actually put dents in some cars, similar to hail damage.

If it's a tree of any size, it is too close to the house. I'd get rid of it.

I have no idea what it is, but public hermit is absolutely right! Get rid of it now because the bigger it gets the harder it will be to remove. I have invasive trees and honeysuckle popping up all over!

I am one of the leading world experts on trees and bananas. You will need to take a better picture, higher definition. In order for someone who lives in trees to identify it.

I am guessing that it is a Black Walnut tree. pics here:

If you dig it up carefully you might find confirmation of that in the trunk growing from an old walnut shell.
Black walnuts are good trees to have, but they need lots of space to spread out.

I think it might be an American beech tree. Notice that it's trunk is not furrowed. Here is a pic of beech leaves.

My other guess would be some fruit tree. You should be able to easily cut it down if you wait a coupe of years. unless of course the Hoa gives you notice.
