The OP and (surprise) WorldNet Daily are both in error, in that the court did not declare atheism a religion. The court found that a religion can be atheist. That ought to be rather obvious. For instance, many Buddhists are atheists. The court did not find that atheism, as such, is a religion.

The court held that, for first amendment purposes, atheism will be considered a religion:

...[W]e have suggested in the past that when a person sincerely holds beliefs dealing with issues of "ultimate concern" that for her occupy a "place parallel to that filled by...God in traditionally religious persons," those beliefs represent her religion....We have already indicated that atheism may be considered, in this specialized sense, a religion.

The court, of course, wouldn't touch the non-legal question, whether atheism is actually a religion, with a 10-foot pole.
