Balance of Power

I assume most are familiar with the idea of governmental checks & balances: veto, referendum, impeachment, judicial review, budget allocation, etc.

But is there a check you think is missing that should be added?

Absolutely, yes.

I think a government should be forced to explain how laws go towards making society safer, or more thriving.
For example, since we cannot explain how banning gay marriage makes society safer or more thriving then a law against gay marriage cannot be justified by government.

This would put a check on the power of government over the ability for people to make their own choices.
