In criminal court you need 95% probability. They really do not even have the 51% and they are a long way off from the 95% they would need with the GOP dominated senate.

The problem is going to be what happens when he gets there. He could tear that liberal court apart and bring his fellow Justices up on charges of corruption and get them impeached to turn the court into a radical conservative court.
