No, it's not like that. As the rules say, it is not an act of discrimination. It is there to respect the rights of those who do not wish to be exposed to dissenting views.

Not really, the permission would just be so that the moderator knew which threads to flag as what. It's not like it would ever be denied. Denial would only ocurr for those who have manifested themselves to be continual trouble-makers and are interested only in offending people, not debating.
