Although I truly believe this encounter between us was consensual, I recognize now that she did not and does not view this incident the same way I did.

No, he said he was very sorry for the misunderstanding, and that obviously she had understood events that had happened that evening very differently from the way he had. Coming as a statement made directly after prosecuters said the case was dead and never would be ressurected it's a very noble speech that attempts to preserve her dignity and make her look like something other then a gold digger. I mean if it had been made during a major portion of the trial in which he was losing it would look bad, but as a speech from what is basically complete victory it's a very nice gesture.

It is a very lawerly statement. Nothing more and nothing less. You don't think Kobe wrote it do you?
True, because it would have come out like, "Yo, dawg, I was innocent, when me and my..." followed by some words that I cannot print here. :p

yes. he admitted that the woman thought it wasn't consensual. It doesn't matter what he thinks. As long as one party didn't think it was consensual, it's rape.

I recognize now that she did not and does not view this incident the same way I did.

Yeah, except she went home had sex with another boyfriend and then decided it was non-consensual. And he just HAPPENS to have some money. It seems just a little contrived, neh?

So... if one person thinks its consensual... but the other person does not... it's not rape?
Bingo.

Not really. Perhaps she wanted to have sex with the other guy but not with Kobe?
