Yes it is, but for Pete's sake don't announce a discriminatory action. Just keep your mouth shut and off someone to be the judge. When you announce a discriminatory choice it's fair game to be trounced for it.
It is the prerogative of the President whom to nominate, it necessarily discriminates against all those who are qualified, but do not get selected.
It’s top-down decision, people do not “apply to be a Justice”.

So are men.

So are men.

So what differentiates a woman from a man? Let me be more direct. Look at the picture below and tell me if the person is a woman or a man. Why is it a woman or a man?

Because God designed her that way.

You used the pronoun "her." Does that mean you are suggesting the person is a woman? What "design" makes her a woman as opposed to a man?

Well...it is impossible to discriminate against something that cannot be defined. So technically Biden has nothing to worry about.

It's no suggestion, it's a feminine pronoun indicating the female of the species. She was made from a piece of Adam. Everyone knows she has a uterus.

So a uterus is a defining factor of a female and should be referred to as She/her. What if Clarance Thomas identified as a woman. Would she be the first black woman Supreme Court Justice?

Could you then define "woman" as an adult female of the human species? Since you established that a female has a uterus, women have a uterus?

I know right? For being so focused on putting a black woman on the Supreme Court, liberals can't even differentiate a woman from a man. I wonder... if Clarence Thomas put on a wig and dress and demanded we use the She/her pronouns, would the left celebrate her as the historic first black woman Justice?

Yes they would!

But there is an opening. And it's discriminatory to say only a Black woman will be chosen for the position.

A piece of Adam.

So not an answer. You are really good at that. Thanks for playing.

You will totally use a dictionary for definitions you liked but totally bail when dealing with a definition you don't. Thanks for playing. But your lack of credibility has been exposed.

Say you have a soccer team and need a new player. You choose the player to fit the team. It's not discriminatory to choose a goalie if that's what you need. We currently are lacking the black, female perspective on the bench. The other members on the bench hold their own viewpoint. You can't have an entire team of one position.
Of course she must be a qualified, constitutional scholar. No one is debating that. Perhaps one day we'll get to a point where these distinctions don't matter. Until then, it makes no sense to pretend that they don't.

I honestly don't think so. The Democrats lothe diversity of thought and despise anyone who doesn't think as they do. If such a hypothetical scenario were to come to fruition, it would be likely that the progressive mob would attack and slander Clarissa Thomas as a fraud. "We want a black woman...just not that one."

I am trying so hard to keep on topic. But I think it is seriously ironic and sad that the same people who demand a black woman on the Supreme Court can't even tell me what a "woman" is.

Let it be known for the record that progressives want a black piece of Adam in the Supreme Court.

We have a black and three females on the bench already. Having a black female is not going to bring much to the table that isn't already there. After all, white women have the right to speak on behalf of all racial minorities. So I don't know what the issue is.

No, it only intentionally discriminates against the 93% of the population that was not born as a black female.

A piece of Adam.
Would a humanist agree with that definition?.......or a non-believer?
Then by what standards would they operate? Or do you think it (definition of a woman) can mean different things to different groups and demographics? And if so please give some examples so we can better grasp your thinking.

How is it a discriminating process? What qualifications does the constitution spell out that would cause any such discrimination?
