Congress did forward a criminal contempt recommendation but the DoJ decided not to pursue it. The situations aren't really the same though. AG Holder at the time was a senior administration official and invoking Executive Privilege on the behalf of the current president. That's a pretty clear cut use of Executive Privilege. Steve Bannon is a private individual, and was one at the date in question, attempting to invoke Executive Privilege on the behalf of the former president, which it isn't clear has the right to invoke EP any more. The proper response to that inclarity would have been to file an injunction against Congress, not just ignore the subpoenas.Our two tiered justice system. Was Holder indicted for contempt like Steve Bannon was?
