I have a problem with the $1000 bail of the career criminal suspect in Waukesha when compared with protesters at the Capitol who committed no acts of violence and get solitary confinement with no bail--and harsh sentences if they plead guilty despite no prior criminal record. I believe that people should receive equal treatment under the law, no matter their race, political affiliation, or religion of the person. I know many at imprisoned for the fake "insurrection" are not being allowed to religious services and are held under horrible conditions. What do you think? Should each individual receive equal due process?

That bail is ridiculous but so is the notion of the Capitol rioters being harmless.
What if someone decided you were not harmless, would that justify solitary confinement for ten months with no bail?

Sounds like youre suggesting there should be a national standard for all matters of criminal law, rather than different rules in different states. Is that right?

I dont think that is due process but regardless, bail is at individual discretion. That cannot be made unifrom

Bail reform:

-Are you a flight risk and there is good reason you will not appear for your court date?
-Do you reasonably pose a risk to the safety of others?

If the answer to those questions is "No" then you should be free until your court date. No cash bail.

If the answer to any of those is "Yes", then the next question is "Are there steps we can take to make it a 'No', like an ankle monitor?" If the answer is "Yes", then institute that. If the answer is no, then keep them in jail for a speedy trial.

Cash bail should not be an option. If the threat of jail time for failing to show up for your trial is not enough to get you to show up for your trial, then the threat of forfeiting money doesn't either. It's just a means of keeping poor people who cannot afford cash bail in jail pending trial.

In the case of the OPs, the guy let out on bail shouldn't have, given that he had previously jumped bail.

Yeah, America’s legal system is shockingly not fit for purpose. I suppose it comes from the lack of a consistent approach across the states. And the prison industry needs a constant flow of indentured servitude.
