Andrew McCabe, fired by Trump, gets pension back - CNNPolitics

Former FBI Deputy Director Andrew McCabe, who had been fired hours before his retirement as then-President Donald Trump's political furor toward him grew, has settled a lawsuit with the Justice Department, allowing him to officially retire and to recoup hundreds of thousands of dollars in legal fees and his pension.

McCabe, now a CNN law enforcement analyst, was one of the central leaders of the early Russia investigation that pursued Trump's advisers and questions of whether the then-President had obstructed justice. In March 2018, two days shy of McCabe's scheduled retirement date, when he would have become eligible to receive early retirement benefits, then-Attorney General Jeff Sessions fired him from the FBI.

So he gets his pension dating back to when he was fired, legal fees paid, the firing explunged from his record at the FBI and his badge mounted in honor like other retirees.
I think that is vindication. :)

He was fired for political reasons and this result supports that.

Why wouldn't this result support that he was vindicated for political reasons?

Mr. McCabe thanked his lawyers at the firm of Arnold & Porter, who will receive more than $500,000 in legal fees paid by the government. The firm intends to donate the money to its foundation, which provides scholarships to minority law students, among other things.

“What happened to Andrew was a travesty, not just for him and his family, but the rule of law,” said Murad Hussain, one of Mr. McCabe’s lawyers. “We filed this suit to restore his retirement benefits, restore his reputation and take a stand for the rights of all civil servants, and that’s exactly what this settlement does.”

...assisting minority law students is "racially motivated"?

Does it racially discriminate? If so, on principle, I would rather that the taxpayers just bought them another yacht.

Yep, that's what happens when people vote in incompetent public officials who make obvious mistakes. If having to pay for those mistakes from our tax dollars really bothers someone, they should probably chose more qualified candidates rather than electing a washed-up ex reality TV star.

I'm glad he worked it through the system and his years of service has been restored. Especially for his family. He's dirty, but evidently that isn't a termination offense.

Sessions said "After an extensive and fair investigation and according to Department of Justice procedure, the Department’s Office of the Inspector General (OIG) provided its report on allegations of misconduct by Andrew McCabe to the FBI’s Office of Professional Responsibility (OPR).

The FBI’s OPR then reviewed the report and underlying documents and issued a disciplinary proposal recommending the dismissal of Mr. McCabe. Both the OIG and FBI OPR reports concluded that Mr. McCabe had made an unauthorized disclosure to the news media and lacked candor — including under oath — on multiple occasions.

The FBI expects every employee to adhere to the highest standards of honesty, integrity, and accountability. As the OPR proposal stated, “all FBI employees know that lacking candor under oath results in dismissal and that our integrity is our brand.”

Pursuant to Department Order 1202, and based on the report of the Inspector General, the findings of the FBI Office of Professional Responsibility, and the recommendation of the Department’s senior career official, I have terminated the employment of Andrew McCabe effective immediately."

Fact Andrew McCabe under oath swear “to tell the truth, the whole truth, and nothing but the truth.” And he did not and It was not TRUMP that said "Both the OIG and FBI OPR reports concluded that Mr. McCabe had made an unauthorized disclosure to the news media and lacked candor — including under oath — on multiple occasions.". Sessions did. Now I am just guessing but OIG FBI OPR above McCabe have some kind of say yet its OK! Now no matter what he will be remembered for the mistakes he did how it effected the FBI. Many of the FBI that has been reported feel this way. They are not happy.

McCabe alleged that the report’s release was sped up “only after” his testimony suggested that he would corroborate Comey’s accounts of his conversations with Trump.

“Here is the reality: I am being singled out and treated this way because of the role I played, the actions I took, and the events I witnessed in the aftermath of the firing of James Comey,” McCabe said in a statement. “The OIG’s focus on me and this report became a part of an unprecedented effort by the Administration, driven by the President himself, to remove me from my position, destroy my reputation, and possibly strip me of a pension that I worked 21 years to earn. Andrew G. McCabe, the former deputy F.B.I. director and a frequent target of President Trump’s, will not face charges in an investigation into whether he lied to investigators about a media leak, his defense team said on Friday.

The decision by prosecutors in Washington ends a case that had left Mr. McCabe in legal limbo for nearly two years. It also appears to be a sign that Attorney General William P. Barr wants to show that the Justice Department is independent from the president: The notification came a day after Mr. Barr publicly challenged Mr. Trump to stop attacking law enforcement officials on Twitter and said the criticisms were making his job more difficult.

The prosecutors informed Mr. McCabe’s lawyers of their decision by phone on Friday morning, the lawyers, Michael R. Bromwich and David Schertler, said in a statement.

“We said at the outset of the criminal investigation, almost two years ago, that if the facts and the law determined the result, no charges would be brought,” they said. “We are pleased that Andrew McCabe and his family can go on with their lives without this cloud hanging over them.”

The president’s relentless criticism of the Justice Department probably complicated the prosecution of Mr. McCabe. His supporters viewed the investigation as politically motivated and inextricably tainted by Mr. Trump’s relentless attacks.

The lack of charges is likely to anger the president, who has long believed he was targeted illegally by Mr. McCabe and other former senior F.B.I. officials who opened the investigation in 2016 into whether his campaign conspired with Russia’s election interference operation.

So was OJ. It must be nice to be able to spend a half a million on attorneys.

The rest of us generally have to wish and hope that the unemployment office will throw us some scraps; if we get fired after trying to undermine our boss.

The lawyers can spend the money as they wish. Neither McCabe or any of us reading about it have any say.
