Judge Dismisses NRA Bankruptcy Case, Heightening Risk For Dissolution Of Group

A federal bankruptcy judge dismissed an effort by the National Rifle Association to declare bankruptcy on Tuesday, ruling that the gun rights group had not filed the case in good faith.

The ruling slams the door on the NRA's attempt to use bankruptcy laws to evade New York officials seeking to dissolve the organization. In his decision, the federal judge said that "using this bankruptcy case to address a regulatory enforcement problem" was not a permitted use of bankruptcy.

Looks like the NRA is going to be mounted on the New York Attorney General's wall after all.

Since the Democrats are back in control, a fiery speech denouncing the government and their jack booted thugs who will soon be kicking in doors to seize people's guns unless they send a check immediately to stop the steal, uh, I mean grab.

It's not like they're hurting for money:

...But I'm sure LaPierre could use a new summer home.

This was on facebook today. This is why the Democratic Party can pass all the draconian gun laws they want to and it will have virtually no affect on gun violence in the US.

Well thank God for the US Coast Guard seizing all those dangerous weapons. However, the Fifth Fleet is nowhere near the United States and the dhow carrying them would not have ever made the trip to the west coast. But then, I am not in the Navy and just didn't leave the Fifth Fleet AOR (area of operation) 11 days ago. Oh, wait, I am.

Too bad that the 5th Fleet is the only nautical force the US has to to prevent smuggling into the country.

The 5th fleet is nowhere near the United States, it is in the Persian Gulf. Your cheap Chinese AK47 knockoff is safe from the 5th fleet and your high capacity magazines aren't going to be taken away by the 5th fleet unless you are sailing around on an Iranian yacht smuggling weapon to rebels.

I will just say that Letitia James lost my respect when she campaigned for NY Attorney General by calling the NRA a ‘terrorist organization.’

I was shot down 5 times in Viet Nam by cheap Chinese AK47 knockoffs. I don't happen to have any AKs or large capacity magazines so the first step in gun grabs doesn't bother me but it is the next several steps when gun haters grab all guns.

Good...

Even as a pro-gun person (although some who also identify as pro-gun would call me a sell-out because I support universal background checks and mandatory mental health screening and licensing), it doesn't take much research to realize that the NRA is a fraud given their unimpressive legal track record given the vast sums they've taken in from donors over the years.

The major wins for gun owners (from a court/legal standpoint) have come from a much smaller - but more effective - organization called "The Second Amendment Foundation" (and that only has a $4 million dollar budget), and the NRA has constantly tried to piggy back off of their wins and claim the victories as their own.

DC v Heller
McDonald v Chicago

Those wins came about as a result of 2AF in the form of Alan Gottlieb (who looks like Mene Gene Okerlund), Massad Ayoob (a firearms instructor of Syrian descent), and their premier litigator, Alan Gura.

During the DC v Heller case, the NRA tried to file a motion to have their case consolidated with Alan Gura's after he'd already won the case so that they could claim "hey look!, we defended your rights!"

Gura had some choice words for them:

Attorney Alan Gura, in a 2003 filing, used the term "sham litigation" to describe the NRA's attempts to have Parker (aka Heller) consolidated with its own case challenging the D.C. law.

And it's not the first time the NRA had pulled that sort of stunt...they'd also try to file motions (in cases where the actual litigators already had it in the bag), to allow them to read statements before the ruling was delivered, so that they could pretend that whatever arbitrary statement they made, was the reason why the case was won so they could justify their existence to their donors.

If you want to actually win a gun rights cases, you donate to 2AF. If you want to pay $500 for a cheesy tote bag and drink tumbler (that's "perfect for home, office and travel!!)

...then by all means, give your money to the NRA.

Once more too bad the 5th fleet is the only resource the US has to deter smuggling guns, drugs, human trafficking etc.
