18 USC 2384 If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.

Lin Wood and Rep. Louie Gohmert are calling for armed demonstrators to prevent lawmakers from reaching Congress on Wednesday. That is seditious conspiracy clearly within the meaning of the act.

Every time I see this man, I swear, he’s either doing or saying something stupid. Boggles me that he’s had his job for so long.

Insanity is a defense. Is stupidity? I think you'd have to show such a low IQ that he was incapable of understanding the meaning of what he is doing. That seems unlikely.

Yes. I thought the poster was referring to the continuing stream of stupid court cases. This would seem to fit the definition of sedition. But it may be necessary to have an actual act. That is, if armed demonstrators do attempt to stop Congress, then one might be able to charge Wood and Gohmert. But if nothing happens, I'm not so sure.
I probably should have clarified. I mean the meaningless court cases are one thing (which can be punished by other means anyway) but the threats of violence were my main issue.

I wonder if Pence will say anything about the phone call to GA officials? It seems unlikely that he will do so, but anything is possible.
Ya mean the phone call where he “asks” the GA Sec of State for a favor? The favor being to find enough votes to win the state?

That's not quite how I heard it. It wasn't a favor. Trump believes he actually got the votes.

He has the power to preside - nothing more. If Pence were to try "acting", a Senator- only needs to object -triggering a debate and vote by both houses of Congress - according to Sen. Klobuchar's interview on the PBS newshour today.

As I understand it, the VP’s role is just ceremonial. He reads out the electoral votes that each state has certified. He has no authority to reject any EVs. Claiming otherwise is like saying the ring announcer at a prizefight can overrule the judges’ determination of which fighter won on points.
