Intentional killing, or murder, of the born: Verdict Death Penalty

Deuteronomy 19:11-12 But if out of hate someone lies in wait, assaults and kills a neighbor, and then flees to one of these cities, the killer shall be sent for by the town elders, be brought back from the city, and be handed over to the avenger of blood to die.

Unintentional killing of the born: Verdict Banishment

Deuteronomy 19:1-10 ESV
“When the Lord your God cuts off the nations whose land the Lord your God is giving you, and you dispossess them and dwell in their cities and in their houses, you shall set apart three cities for yourselves in the land that the Lord your God is giving you to possess. You shall measure the distances and divide into three parts the area of the land that the Lord your God gives you as a possession, so that any manslayer can flee to them. “This is the provision for the manslayer, who by fleeing there may save his life. “When men strive together and hit a pregnant woman, so that her children come out, but there is no harm, the one who hit her shall surely be fined, as the woman's husband shall impose on him, and he shall pay as the judges determine. But if there is harm, then you shall pay life for life, eye for eye, tooth for tooth, hand for hand, foot for foot, burn for burn, wound for wound, stripe for stripe

It seems that YHWH sets a higher price on the unborn, than on the born.

You're mistaken. Read it again carefully. In both cases, two men are fighting each other. In both case one of the men accidentally hits a pregnant woman in the course of fighting the other man.

In the first case, the baby comes out unharmed. A fine is imposed.

In the second case, the baby is harmed. The punishment is equal to the harm, death for death.

The fighting was intentional, though, I would think. But in the case of an accidental killing with an ax, the workers are doing what they are supposed to do . . . not fighting.

I see how fighting can be like drunken driving > you are liable for how you hurt someone while driving drunk, or while emotionally drunk enough to fight.

That's a good point; but in the case of ax, and the case of the unborn child, neither was intentional.

The Scriptures do differentiate between innocent “blood” aka life over life (a person) who intentionally sheds other blood.

I'm sure it does. They were written in a time when life was harsh and violent That does not change the difficulty in claiming life is very valuable when it's treated so cheaply.
