Trump couldn't be prosecuted if he shot someone on Fifth Avenue, lawyer claims

Trumps lawyers are in court resisting a state subpoena for his tax records on the grounds that is is illegal to investigate a sitting president for a crime.
Lawyers will make any claim their client wants as long as the check doesn't bounce.

My guess is that he CAN be investigated while he is president. He may be protected from being charged and arrested.

However there is no reason I'm aware of that a DA couldn't gather the information needed to charge a president as soon as the president becomes a former president.

It is not illegal, it is just recommended in a DOJ memo. That does not have the power of law.

not even -- a sitting president can't be indicted... there's no reason one can't be investigated.

It is not even illegal to indicted him either. The DOJ has decided not to, but there is no law saying you can't.

to be on the safe side everyone should positively stay on 4th street

Nah, avoid 5th Ave altogether... Head over to 10th Ave., down in Chelsea -- there's a place that has the best mozzarella sticks...

I do not think that the founding fathers ever envisioned a president who wanted to be king.
Ermmm. Yes they did, it’s one reason there is a clear separation of powers, checks and balances in the constitution.

As a Christian, I'm sad to say that I don't think it would make any difference to his supporters if he did shoot someone anywhere. In fact, it would be a self-fulfilling prophecy for Trump. I feel I can say that after witnessing his supporters faithfully defend him for three years as if their life depended upon it.

Perhaps at this point, it does.

Yep, it was one of the things they were most worried about and eager to prevent. Even considering the different standards of their time to ours, I still think they’d be utterly shocked by this administrations argument to this court.

Actually they did and that's why they created the three equal branches of the government.

Dang! I wish someone had educated Donald Trump about all this troublesome stuff.

oh I think they did...hence the power to impeach.

(edit) However, I don't think anyone anticipated the American people voting for someone who has no moral compass...

Especially when they KNEW he had no moral compass before they voted.

It is especially interesting this is the opinion of a federal agency, while the question is about the power of state courts. So this should be an easy choice for people who believe in states' rights.
