Court says Trump can continue policy requiring asylum-seekers to remain in Mexico

The 9th Circuit Court of Appeals on Tuesday ruled that the Trump administration can continue to enforce a policy requiring some asylum-seekers to remain in Mexico while their cases are processed.

The ruling from the San Francisco-based appeals court places a stay on a preliminary injunction on the asylum policy issued by a lower court.

The panel of judges wrote in the opinion that the Department of Homeland Security (DHS) had shown that it was likely to suffer irreparable harm if the policy was halted because it “takes off the table one of the few congressionally authorized measures available to process the approximately 2,000 migrants who are currently arriving at the Nation’s southern border on a daily basis.”

The judges also found that the policy was not implemented in violation of the Administrative Procedure Act because it is not one of the policies covered by the act and therefore does not require certain processes to take place ahead of its implementation.

Several immigration groups had sued DHS over the policy on behalf of migrants affected by the policy, arguing that the practice was improperly implemented and put the migrants in harm’s way.

However, some of the judges were highly critical of DHS’s implementation of the policy in individual opinions authored on the decision, signaling that they could oppose the policy in a later ruling.

Judge Paul Watford, an Obama nominee, wrote in his opinion that he believes the administration’s treatment of asylum-seekers is in violation of the U.S.’s obligation to not return those migrants to countries where they could face persecution.

He pointed to DHS guidelines that state that immigration officers ask applicants who are being returned to Mexico if they fear persecution or torture in the nation only if the migrants say so themselves first.

I find it interesting that the liberal media has decided to rebrand illegal aliens as "asylum seekers." They cannot bring themselves to call these people what they are: Illegal aliens. They call them "migrants" or "undocumented immigrants" or now, "asylum seekers." They make every effort to avoid the word "illegal." It's all about shaping public opinion.

It is similar to how back in 2015 when we were talking about bringing Syrian refugees from the middle east, the media and the government re-labeled the refugees as "immigrants." "Refugee" is a temporary status, but the powers that be decided they would change to a more permanent status and call them "immigrants," meaning that the US would simply give them permanent residence. This is all part of the liberal open borders policy. What didn't happen with regard to Syrian refugees, is now happening at our southern border.

What is worse is that these illegals are being treated as if they are "immigrants" which is a slap in the face to actual immigrants who obey the rules, who come here legally and wait their turn in line. We have tens of thousands of people who know they can use the word "asylum" like a magic word to get into our country illegally. They abuse our system and we need to turn these people back. We have no legal or moral obligation to take in everyone who shows up.

If these people were "asylum seekers," they would not try to enter the country illegally. They would seek legal entry as opposed to trying to break our laws.

I noticed that too. Not everyone rushing the US Southern border is an asylum seeker. I think the issue is the cartels are in glee having large groups to keep the USBP busy while they send in their drug 'mules.'

You would think every American and legal resident would be concerned with this. But since it is Trump who is calling for better border security it has to be opposed.

You would think every American and legal resident would be concerned with this. But since it is Trump who is calling for better border security it has to be opposed.

They have been reporting about 'renting' children since 2014 as cover to get across. That was prior to Trump, and that didn't raise any eyebrows at all it seems.

A couple of months ago I was watching a Mexican television station, and majority of the ones stuck in Mexico were not seeking asylum due to violence, etc. They wanted jobs. They organizers of the caravans told them that was good enough to get in, and not to many were worried about them being lied too.

Citizens living along the border have been screaming their heads off about the crime they have been dealing with, and yet you have some government leaders of those states claiming 'nothing to see here'.

I was listening to a hearing this last week when many of the agencies involved came to testify, and they sound pretty desperate. They had maybe 10 congress members come to listen, and many just said their little speech that had nothing to do with anything...and left.

Sadly, I think something truly tragic has to happen before anyone pays much attention - at least those that have the power to do anything that is. Even then? We would have to wait until they are done pointing fingers - for political purposes of course - before they maybe, they might then, actually do something. I'm not holding my breath.

People have got it in their heads that if you control the borders like many nations do? Your racist, your don't care about the downtrodden, etc. This black and white thinking that is all the rage today? It isn't rational, but it seems good enough for the powers that be.

I was listening to a hearing this last week when many of the agencies involved came to testify, and they sound pretty desperate. They had maybe 10 congress members come to listen, and maybe just said their little speech that had nothing to do with anything...and left.
Why would they be concerned unless it was happening in their own backyard. A lot of members of Congress are pressured by the cheap labor lobbies of corporations. Add to that the Democrats see future votes (maybe immediate when you consider local elections).
