According to a Justice Department rule that hasn't been made up yet.

“The Department of Justice has informed us that it intends to memorialize its advice in a published legal opinion as soon as practicable. Out of respect for the deadlines previously set by the Committee, and consistent with our commitment to a prompt response, I am informing you now that the Department may not lawfully fulfill the Committee’s request,” the letter read.

Neal originally demanded access to Trump’s tax returns in early April under a law that said the IRS “shall furnish” the returns of any taxpayer to a handful of top lawmakers, including the chair of the tax-writing Ways and Means Committee.

The law they are using doesn't say that they need a reason. But laws are funny things that only bind Democrats. They're more like guidelines for Republicans.

What's truly pathetic is that Donald won't voluntarily submit them. Nobody has done a better job making Donald J Trump look like he's guilty as heck & covering his tail than Donald J Trump.

Now as for the Mueller report, sure the folks who read the fortune cookie version of it written by Donald's handpicked sycophant think it makes him look like his as pure as the driven snow. Lol. Donald himself didn't even read it. Folks who actually did sure have told a different tale about it. If it exonerated him like he's claimed, well shoot it sure does seem like the 1st person to want Mueller to testify about it would be Donald himself. But nope.

The law says they can get the returns without consent if the committee is in closed executive session.

Without his consent, they can still examine it in a closed session, which is all they have asked for.

The way I read that was
“The Secretary shall release the Return and/or the return information to the Congressperson entitled to request it. If the return or return information can be linked to any particular taxpayer, then the congressional committee must meet ‘closed-doored’ (Executive Session), unless the subject of the inquiry allows it to happen in ‘open session’.”
